| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Cycle Rider Safety Training Act is amended |
| 5 |
| by changing Sections 4, 6, and 7 as follows:
|

| Sec. 4. Any State university or community college, State |
| 8 |
| university
or community agency designated by the Department may |
| 9 |
| organize a
Regional Cycle Rider Safety Training Center and may |
| 10 |
| offer cycle
rider safety training courses through such Training |
| 11 |
| Centers which
it operates. The curriculum and accreditation for |
| 12 |
| the courses,
and the geographic areas in which each Training |
| 13 |
| Center may offer
the courses, shall be provided for by rules |
| 14 |
| and regulations of the
Department. Instructors of such courses |
| 15 |
| shall meet the
qualification and certification requirements of |
| 16 |
| the regulations
of the Department and the college, university |
| 17 |
| or community agency
offering the program and may be employed on |
| 18 |
| a calendar year
rather than a school year basis. Such courses |
| 19 |
| shall be open to
all residents of the State who hold a |
| 20 |
| currently valid driver's
license and who have reached their |
| 21 |
| 16th birthday without regard
to whether such person is enrolled |
| 22 |
| in any other course offered by
said State university or |
| 23 |
| community college, State university or community
agency. Such |

| courses may be offered throughout the calendar year.
The |
| 2 |
| courses may be offered as credit or noncredit courses, but no
|
| 3 |
| fee shall be charged except for a nominal registration fee |
| 4 |
| which
shall be refunded upon completion of the course.

| Sec. 6. To finance the Cycle Rider Safety Training program |
| 8 |
| and to pay
the costs thereof, the Secretary of State will |
| 9 |
| hereafter deposit with the
State Treasurer an amount equal to |
| 10 |
| each annual fee and each reduced fee, for
the registration of |
| 11 |
| each motorcycle, motor driven cycle and motorized
pedalcycle |
| 12 |
| processed by the Office of the Secretary of State during the
|
| 13 |
| preceding quarter as required in subsection (d) of Section |
| 14 |
| 2-119 of the
Illinois Vehicle Code, which amount the State |
| 15 |
| Comptroller shall transfer
quarterly to a trust fund outside of |
| 16 |
| the State treasury to be known as the
Cycle Rider Safety |
| 17 |
| Training Fund, which is hereby created. The State Treasurer |
| 18 |
| shall appoint the trustee for this fund to serve a term of 3 |
| 19 |
| years, subject to possible reappointment. In addition, the
|
| 20 |
| Department may accept any federal, State, or private moneys for |
| 21 |
| deposit into
the Fund and shall be used by the Department only |
| 22 |
| for the expenses of the
Department in administering the |
| 23 |
| provisions of this Act, for funding of
contracts with approved |
| 24 |
| Regional Cycle Rider Safety Training Centers for the
conduct of |
| 25 |
| courses, or for any purpose related or incident thereto and
|

| connected therewith.

| Sec. 7. The trustee of the Cycle Rider Safety Training |
| 5 |
| Fund, in consultation with the Department, is authorized to and |
| 6 |
| shall award
contracts out of appropriations to the Department |
| 7 |
| from "The
Cycle Rider Safety Training Fund" to qualifying |
| 8 |
| Regional Cycle
Rider Safety Training Centers for the conduct of |
| 9 |
| approved Cycle
Rider Safety Training courses.

| Section 99. Effective date. This Act takes effect upon |
| 12 |
| becoming law.
