| 1 |  |     AN ACT concerning roads.
 | 
| 2 |  |     Be it enacted by the People of the State of Illinois,
  | 
| 3 |  | represented in the General Assembly:
 | 
| 4 |  |     Section 5. The Illinois Highway Code is amended  by adding  | 
| 5 |  | Section 4-220 as follows:
 | 
| 6 |  |     (605 ILCS 5/4-220  new) | 
| 7 |  |     Sec. 4-220. Bicycle and pedestrian ways. | 
| 8 |  |     (a)  Bicycle and pedestrian ways shall be given full  | 
| 9 |  | consideration in the planning and development of  | 
| 10 |  | transportation facilities, including the incorporation of such  | 
| 11 |  | ways into State plans and programs. Bicycle and pedestrian ways  | 
| 12 |  | may be established in conjunction with the construction,  | 
| 13 |  | reconstruction, or other change of any State transportation  | 
| 14 |  | facility, and special emphasis may be given to projects in or  | 
| 15 |  | within one mile of an urban area. | 
| 16 |  |     (b)  Notwithstanding the provisions of subsection (a),  | 
| 17 |  | bicycle and pedestrian ways are not required to be established: | 
| 18 |  |         (1) where their establishment would be contrary to  | 
| 19 |  | public safety; | 
| 20 |  |         (2) when the cost would be excessively  | 
| 21 |  | disproportionate to the need or probable use; | 
| 22 |  |         (3) where other available means or factors indicate an  | 
| 23 |  | absence of need; or |
