AMENDMENT TO SENATE BILL 258

    AMENDMENT NO. ______. Amend Senate Bill 258 on page 6, line 
3
23, by replacing "tenant, or" with the following:

"tenant by the mortgagee by certified mail as defined in 
5
paragraph (5) of subsection (h) of this Section, or"; and
 
6
on page 7, immediately below line 1, by inserting the 
7
following:

        "(5) The notice required by item (i) in paragraph (4) 
9
    of this subsection (h) shall be served by certified mail, 
10
    return receipt requested, to each tenant at such tenant's 
11
    abode and to the mortgagee at its main office. A receipt 
12
    from the United States Postal Service that is signed by any 
13
    adult member of the household to which it was mailed, or a 
14
    notation on the letter that the letter was refused by any 
15
    adult member of the tenant household, or that the addressee 
16
    no longer resides there, or that the letter was returned to 
17
    the post office unclaimed, shall constitute a conclusive

    presumption that service was made in any court action in 
2
    this State. A receipt from the United States Postal Service 
3
    that is signed by a representative of the mortgagee shall 
4
    constitute a conclusive presumption that service was made 
5
    on the authority in any court action in this State.".
