| AN ACT concerning local government.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Power Agency Act is amended by |
| 5 |
| adding Section 1-128 as follows: |
| 6 |
| (20 ILCS 3855/1-128 new) |
| 7 |
| Sec. 1-128. Renewable energy program. The Agency shall, in |
| 8 |
| conjunction with the Department of Commerce and Economic |
| 9 |
| Opportunity, develop a program to promote renewable energy and |
| 10 |
| net-metering options in the State. |
| 11 |
| Notwithstanding any other rulemaking authority that may |
| 12 |
| exist, neither the Governor nor any agency or agency head under |
| 13 |
| the jurisdiction of the Governor has any authority to make or |
| 14 |
| promulgate rules to implement or enforce the provisions of this |
| 15 |
| Section. If, however, the Governor believes that rules are |
| 16 |
| necessary to implement or enforce the provisions of this |
| 17 |
| Section, the Governor may suggest rules to the General Assembly |
| 18 |
| by filing them with the Clerk of the House and the Secretary of |
| 19 |
| the Senate and by requesting that the General Assembly |
| 20 |
| authorize such rulemaking by law, enact those suggested rules |
| 21 |
| into law, or take any other appropriate action in the General |
| 22 |
| Assembly's discretion. Nothing contained in this Section shall |
| 23 |
| be interpreted to grant rulemaking authority under any other |
