    AMENDMENT NO. ______. Amend House Bill 5489 by deleting

line 24 on page 8 through line 1 on page 9; and

on page 31, by replacing lines 16 through 19 with the 
5
following:

    "(215 ILCS 5/1600 new)

    Sec. 1600. Rules. 

Notwithstanding any other rulemaking 
8
authority that may exist, neither the Governor nor any agency 
9
or agency head under the jurisdiction of the Governor has any 
10
authority to make or promulgate rules to implement or enforce 
11
the provisions of this Article.  If, however, the Governor 
12
believes that rules are necessary to implement or enforce the 
13
provisions of this Article, the Governor may suggest rules to 
14
the General Assembly by filing them with the Clerk of the House 
15
and Secretary of the Senate and by requesting that the General 
16
Assembly authorize such rulemaking by law, enact those

suggested rules into law, or take any other appropriate action 
2
in the General Assembly's discretion.   Nothing contained in this 
3
Article shall be interpreted to grant rulemaking authority 
4
under any other Illinois statute where such authority is not 
5
otherwise explicitly given.  For the purposes of this Article, 
6
"rules" is given the meaning contained in Section 1-70 of the 
7
Illinois Administrative Procedure Act, and "agency" and 
8
"agency head" are given the meanings contained in Sections 1-20 
9
and 1-25 of the Illinois Administrative Procedure Act to the 
10
extent that such definitions apply to agencies or agency heads 
11
under the jurisdiction of the Governor.".
