|
Amends the Cannabis Control Act and the Illinois Controlled Substances Act. Provides that a person who violates any of these Acts relating to the illegal manufacture, delivery, or possession of cannabis or a controlled substance while serving a sentence of periodic imprisonment or while on furlough, day release, work release, or home confinement shall be sentenced to a term of imprisonment of not less than twice the minimum term and fined not less than twice the minimum fine as otherwise authorized by these Acts.

| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Cannabis Control Act is amended by adding |
| 5 |
| Section 7.1 as follows: |
| 6 |
| (720 ILCS 550/7.1 new) |

| Sec. 7.1. Violating Act while serving a sentence of |
| 8 |
| periodic imprisonment or while on furlough, day release, work |
| 9 |
| release, or home confinement. A person who violates this Act |
| 10 |
| while serving a sentence of periodic imprisonment or while on |
| 11 |
| furlough, day release, work release, or home confinement shall |
| 12 |
| be sentenced to a term of imprisonment of not less than twice |
| 13 |
| the minimum term and fined not less than twice the minimum fine |
| 14 |
| as otherwise authorized by this Act. |

| Section 10. The Illinois Controlled Substances Act is |
| 16 |
| amended by adding Section 408.1 as follows: |

| Sec. 408.1. Violating Article IV while serving a sentence |

| of periodic imprisonment or while on furlough, day release, |
