| AN ACT concerning fire safety.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 1. Short title. This Act may be cited as the Fire |
| 5 |
| and Life Safety Device Act. |
| 6 |
| Section 5. Fire protection devices neither designed nor |
| 7 |
| capable of function. |
| 8 |
| (a) The manufacture, installation, or sale of any device or |
| 9 |
| object that reasonably appears to be a smoke detector, |
| 10 |
| sprinkler head, carbon monoxide alarm, heat detector, or any |
| 11 |
| other similar device used for life safety or fire protection |
| 12 |
| that is, in fact, neither designed nor capable of performing |
| 13 |
| such life safety or fire protection function, is prohibited. |
| 14 |
| (b) A person who violates this Act is guilty of a petty |
| 15 |
| offense and shall be fined a maximum of $100 for the first |
| 16 |
| offense, $500 for the second offense, and $1,000 for the third |
| 17 |
| or subsequent offense. Each day that a device or devices are |
| 18 |
| installed in violation of this Section constitutes a separate |
| 19 |
| offense. |

Inspectors employed by municipalities, fire protection |
| 21 |
| districts, and counties, those individuals who meet the |
| 22 |
| requirements of subsection (f) of Section 20 of the Fire |
| 23 |
| Sprinkler Contractor Licensing Act, and individuals licensed |
