| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
| 5 |
| Section 11-1430 as follows:
|

| (625 ILCS 5/11-1430 new) |
| 7 |
| Sec. 11-1430. No smoking with young children in the |
| 8 |
| vehicle. |
| 9 |
| (a) A person may not smoke in a vehicle if any person in |
| 10 |
| the vehicle is a child 8 years of age or younger. |
| 11 |
| (b) A violation of this Section shall not be considered |
| 12 |
| evidence of negligence, shall not limit the liability of an |
| 13 |
| insurer, and shall not diminish any recovery for damages |
| 14 |
| arising out of the ownership, maintenance, or operation of a |
| 15 |
| motor vehicle. |
| 16 |
| (c) A violation of this Section is a petty offense |
| 17 |
| punishable by a fine of not more than $25. |
| 18 |
| (d) A law enforcement officer may not search or inspect a |
| 19 |
| motor vehicle, its contents, the driver, or a passenger solely |
| 20 |
| because of a violation of this Section.
