| AN ACT concerning local government.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Counties Code is amended by adding Section |
| 5 |
| 5-15023 as follows: |
| 6 |
| (55 ILCS 5/5-15023 new) |
| 7 |
| Sec. 5-15023. Water emergencies; well use. A county board |
| 8 |
| of health may declare a water emergency within the county. If a |
| 9 |
| board of health declares a water emergency under this Section, |
| 10 |
| it may regulate well use within the area affected by the water |
| 11 |
| emergency. For the purposes of this Section, "water emergency" |
| 12 |
| means a critical event or series of events that disrupts the |
| 13 |
| availability of clean drinking water, including, but not |
| 14 |
| limited to, drought, overuse, and contamination of the water |
| 15 |
| supply. The county shall have the power to enforce any |
| 16 |
| regulations adopted under this Section.

| Section 99. Effective date. This Act takes effect upon |
| 18 |
| becoming law.
