| AMENDMENT NO. ______. Amend House Bill 5245 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Department of Public Health Powers and |
| 5 |
| Duties Law of the
Civil Administrative Code of Illinois is |
| 6 |
| amended by adding Section 2310-342 as follows: |
| 7 |
| (20 ILCS 2310/2310-342 new) |
| 8 |
| Sec. 2310-342. Umbilical cord blood donations. Subject to |
| 9 |
| appropriations for that purpose, the Department of Public |
| 10 |
| Health shall, by January 1, 2007, prepare and distribute to |
| 11 |
| health and maternal care providers written publications that |
| 12 |
| include the following information: |
| 13 |
| (1) The medical processes involved in the collection of |
| 14 |
| umbilical cord blood. |
| 15 |
| (2) The medical risks to a mother and her newborn child |
| 16 |
| of umbilical cord blood collection. |
| 17 |
| (3) The current and potential future medical uses and |
| 18 |
| benefits of umbilical cord blood collection to a mother, |
| 19 |
| her newborn child, and her biological family. |
| 20 |
| (4) The current and potential future medical uses and |
| 21 |
| benefits of umbilical cord blood collection to persons who |
| 22 |
| are not biologically related to a mother or her newborn |
| 23 |
| child. |
| 24 |
| (5) Any costs that may be incurred by a pregnant woman |

| who chooses to make an umbilical cord blood donation. |
| 2 |
| (6) Options for ownership and future use of the donated |
| 3 |
| material. |
| 4 |
| (7) The availability in Illinois of umbilical cord |
| 5 |
| blood donations. |
| 6 |
| Section 10. The Hospital Licensing Act is amended by |
| 7 |
| changing Section 6.21 as follows:

| (210 ILCS 85/6.21)
|
| 9 |
| Sec. 6.21. Umbilical cord blood donation.
|
| 10 |
| (a) All licensed hospitals shall offer a pregnant patient |
| 11 |
| the option to
donate, to a publicly accessible certified cord |
| 12 |
| blood bank, blood extracted
from the umbilical cord following |
| 13 |
| the delivery of a newborn child if the
donation can be made at |
| 14 |
| no expense to the patient or
hospital for collection or |
| 15 |
| storage.
|
| 16 |
| (b) Nothing in this Section obligates a hospital to collect |
| 17 |
| umbilical cord
blood if, in the professional judgment of a |
| 18 |
| physician licensed to practice
medicine in all its branches or |
| 19 |
| a nurse, the collection would threaten the
health of the mother |
| 20 |
| or child.
|
| 21 |
| (c) Nothing in this Section imposes a requirement upon any |
| 22 |
| hospital
employee, physician, nurse, or hospital that is |
| 23 |
| directly affiliated with a bona
fide religious denomination |
| 24 |
| that includes as an integral part of its beliefs
and practices |
| 25 |
| the tenet that blood transfer is contrary to the moral
|
| 26 |
| principles
the
denomination considers to be an essential part |
| 27 |
| of its beliefs.
|
| 28 |
| (d) Subject to appropriations for that purpose, the |
| 29 |
| Department of Public Health shall make the maximization of |
| 30 |
| umbilical cord blood donations a public health goal. All |
| 31 |
| licensed hospitals and birthing centers shall cooperate with |
| 32 |
| the Department of Public Health in implementing this goal of |
