    AN ACT concerning criminal law.

    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Criminal Code of 1961 is amended by changing

Section 18-3 as follows:

    (720 ILCS 5/18-3)

    Sec. 18-3. Vehicular hijacking.

    (a) A person commits vehicular hijacking when he or she 
9
takes a motor
vehicle from the
the person or the immediate 
10
presence of another by the use of
force or by threatening the 
11
imminent use of force.

    (b) For the purposes of this Article, the term "motor 
13
vehicle" shall have
the meaning ascribed to it in the Illinois 
14
Vehicle Code.

    (c) Sentence.  Vehicular hijacking is a Class 1 felony.
