| AMENDMENT TO HOUSE BILL 1537

| AMENDMENT NO. ______. Amend House Bill 1537 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The School Code is amended by adding Section |
| 5 |
| 10-20.40 as follows: |
| 6 |
| (105 ILCS 5/10-20.40 new) |
| 7 |
| Sec. 10-20.40. Access to food other than federally funded |
| 8 |
| meal program food. Each school board of a school that receives |
| 9 |
| federal funding under the National School Lunch and National |
| 10 |
| School Breakfast programs shall restrict access to all foods |
| 11 |
| not being served as part of the federally funded lunch or |
| 12 |
| breakfast program, including, but not limited to, vending |
| 13 |
| machine foods. |
| 14 |
| Section 90. The State Mandates Act is amended by adding |
| 15 |
| Section 8.29 as
follows:

| (30 ILCS 805/8.29 new)
|
| 17 |
| Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8 |
| 18 |
| of this
Act, no reimbursement by the State is required for the |
| 19 |
| implementation of
any mandate created by this amendatory Act of |
| 20 |
| the 94th General Assembly.

| Section 99. Effective date. This Act takes effect upon |
