| AMENDMENT NO. ______. Amend House Bill 1370 on page 2, line |

| 25 by changing "50%
20%" to "20%"; and

| on page 2, line 27 by changing "5%
2%" to "2%"; and

| on page 2, line 30 by inserting after the period the following: |

| "Where a second or subsequent action to recover underpayments |
| 7 |
| is brought against a contractor or subcontractor and the |
| 8 |
| contractor or subcontractor is found liable for underpayments |
| 9 |
| to any laborer, worker, or mechanic, the contractor or |
| 10 |
| subcontractor shall also be liable to the Department of Labor |
| 11 |
| for 50% of the underpayments payable as a result of the second |
| 12 |
| or subsequent action, and shall be additionally liable for 5% |
| 13 |
| of the amount of any such penalty to the State for |
| 14 |
| underpayments for each month following the date of payment |
| 15 |
| during which the underpayments remain unpaid."; and
|

| on page 3, line 32 by changing "5" to "4".
