| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by changing |
| 5 |
| Section 16-105 as follows:
|

| Sec. 16-105. Delivery services implementation plan. To |
| 8 |
| ensure the
the safe and orderly implementation of delivery
|
| 9 |
| services, each electric utility shall submit to the Commission
|
| 10 |
| no later than March 1, 1999, a delivery services
implementation |
| 11 |
| plan for non-residential customers and no later than August 1,
|
| 12 |
| 2001, a delivery services implementation plan for residential |
| 13 |
| customers. The
delivery services implementation plan
shall |
| 14 |
| detail the process and procedures by which each electric
|
| 15 |
| utility will offer delivery services to each customer class
and |
| 16 |
| shall be designed to insure an orderly transition and the
|
| 17 |
| maintenance of reliable service. The Commission shall enter an
|
| 18 |
| order approving, or approving as modified, the delivery
|
| 19 |
| services implementation plan of each electric utility no later
|
| 20 |
| than 60 days prior to the date on which the electric utility
|
| 21 |
| must commence offering such services. |
