Provides that processing sites or facilities that receive only on-specification used oil originating from used oil collectors for processing to produce products for sale to off-site petroleum facilities are not pollution control facilities under the Environmental Protection Act if these sites or facilities are: (i) located within a home rule unit of local government with a population of at least 30,000 according to the 2000 census, that home rule unit of local government has been designated as an Urban Round II Empowerment Zone by the United States Department of Housing and Urban Development, and that home rule unit of local government has enacted an ordinance approving the location of the site or facility and provided funding for the site or facility; and (ii) in compliance with all applicable zoning requirements. Effective immediately.Senate Floor Amendment No. 1 Adds reference to:415 ILCS 5/39from Ch. 111 1/2, par. 1039415 ILCS 5/39.2from Ch. 111 1/2, par. 1039.2415 ILCS 115/Act rep.Deletes everything after the enacting clause. Amends the Environmental Protection Act. Sets forth that for permits for the development or construction of new pollution control facilities and for local siting approval of pollution control facilities, the appropriate county board or governing body of the municipality for the facility shall be the county board of the county or the governing body of the municipality in which the facility is to be located as of the date when the application for siting approval is filed. Provides that for purposes of obtaining local siting approval for a pollution control facility, garbage transfer station facilities must be in compliance with certain location requirements (unless otherwise exempted from these requirements) as of the date the application for siting approval is filed. Repeals the Illinois Pollution Prevention Act. Provides that the changes made by this amendatory Act apply only to siting applications filed on or after the effective date of this amendatory Act.
