Maloney-Don Harmon) 1/9/2007HouseSession Sine Die New Act Creates the Ice Cream Truck Worker Registration Act. Requires ice cream truck workers to obtain an Ice Cream Truck Worker Identification Card from the Department of State Police. Sets forth rules and procedures for obtaining an identification card. Provides that an application for an identification card shall be denied if the applicant (i) has ever been convicted of any sex offense, (ii) is a registered sex offender, or (iii) has ever been convicted of any homicide offense. Contains other ice cream truck worker requirements. Provides that an ice cream truck owner, upon the request of the municipality or county within which the ice cream truck is to operate, must provide copies of all Ice Cream Truck Worker Identification Cards for employees. Effective immediately.Fiscal Note (Illinois State Police) The fiscal impact to the Illinois State Police would be significant, approaching $900,000. The Bureau of Identification would have to develop application forms, purchase identification card making equipment, hire four personnel to process applications, issue identification cards, conduct appeal proceedings, and establish and maintain the state wide registration database. This would cost the Illinois State Police approximately $280,000 in salaries and fringe benefits, $15,000 for two identification card making machines and supplies, $100,000 for personal computers, software, office equipment and office space construction, $5,000 for forms and other materials for a total cost of approximately $400,000. The personnel costs would be an ongoing expense. Cost figures are based on an estimate of 10,000 ice cream truck workers being required to undergo the registration process each year. Additionally, a system similar to the Firearm Owner's Identification Program would have to be created at a significant cost. House Amendment No. 1 Deletes everything after the enacting clause. Reinserts the provisions of the bill as introduced with the following changes. Provides that the Department of Financial and Professional Regulation (instead of the Department of State Police) shall be responsible for the administration of the Ice Cream Truck Worker Registration Act, including the issuance of identification cards and the establishment of rules concerning the Act, but that the criminal history records check shall still be performed by the Department of State Police. Provides that the Department of State Police shall provide information concerning any criminal charges and their disposition, now and hereafter filed, against an applicant to the Department of Financial and Professional Regulation.
