| 1 | AMENDMENT TO HOUSE BILL 728

| 2 | AMENDMENT NO. ______. Amend House Bill 728 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Vehicle Code is amended by adding | ||||||
| 5 | Section 12-602.1 as follows: | ||||||
| 6 | (625 ILCS 5/12-602.1 new)
| ||||||
| 7 | Sec. 12-602.1. Excessive engine braking noise. | ||||||
| 8 | (a) The driver of a commercial vehicle, as defined in | ||||||
| 9 | Section 1-111.8 of this Code, may not operate or actuate any | ||||||
| 10 | engine braking system that emits excessive noise. | ||||||
| 11 | (b) This Section applies only on highways where appropriate | ||||||
| 12 | signs prohibiting that operation have been erected. The sign | ||||||
| 13 | shall state, "EXCESSIVE ENGINE BRAKING NOISE PROHIBITED". | ||||||
| 14 | (c) The Department of Transportation shall adopt rules | ||||||
| 15 | providing for the
erection and placement of these signs. | ||||||
| 16 | (d) This Section does not apply to the use of an engine | ||||||
| 17 | braking system that has an adequate sound muffling system in | ||||||
| 18 | proper working order that prevents excessive noise. | ||||||
| 19 | (e) It is a defense to this Section that the driver used an | ||||||
| 20 | engine braking system that emits excessive noise in an | ||||||
| 21 | emergency to avoid a collision with a person or another vehicle | ||||||
| 22 | on the highway.".
