AN ACT concerning children.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Birth Control Services to Minors Act is amended by changing Section 1 as follows:

Sec. 1.

(a) As used in this Section:

"Contraceptive services" has the same meaning ascribed to that term in paragraph (2) of subsection (a) of Section 356z.4 of the Illinois Insurance Code, but does not include sterilization.

"Contraceptive supplies" means all contraceptive drugs, devices, and products approved by the federal Food and Drug Administration to prevent pregnancy, including long-acting reversible contraceptives, nonprescription oral hormonal contraceptives, and nonprescription emergency contraceptives.

(b) Any minor may give effective consent for contraceptive services or supplies and the consent of no other person is required. A request for prescription contraceptive services or supplies shall be made to a physician licensed to practice medicine in all of its branches, an advanced practice registered nurse or a physician assistant licensed to practice in the State, or a pharmacist pursuant to the Pharmacy Practice Act. For the purposes of accessing contraceptive services or supplies under this Act, a minor is deemed to have the same legal capacity to act and has the same powers and obligations as a person of legal age. Birth control services and information may be rendered by doctors licensed in Illinois to practice medicine in all of its branches to any minor:

1. who is married; or

2. who is a parent; or

3. who is pregnant; or

4. who has the consent of his parent or legal guardian; or

5. as to whom the failure to provide such services would create a serious health hazard; or

6. who is referred for such services by a physician, clergyman or a planned parenthood agency.
