| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3070, AS AMENDED, |
| 3 | | with reference to page and line numbers of Senate Amendment |
| 4 | | No. 1, on page 5, immediately below line 24, by inserting the |
| 5 | | following: |
| 6 | | "(e-15) A school district may establish a counselor-guided |
| 7 | | process, with the consent of a student's parent or guardian, |
| 8 | | under which the student may be exempted from one or both years |
| 9 | | of the foreign language requirement under clause (i) of |
| 10 | | subsection (e-10). Any such exemption shall be considered only |
| 11 | | after the student receives individualized |
| 12 | | postsecondary-planning guidance aligned with the principles of |
| 13 | | educational equity, college and career readiness, and the |
| 14 | | whole-child approach, to ensure the student is not |
| 15 | | unintentionally excluded from certain future postsecondary |
| 16 | | opportunities. |
| 17 | | The counselor-guided process must include, at a minimum, |
| 18 | | all of the following and shall be implemented in a manner that |

| 1 | | is consistent with guidance issued by the State Board of |
| 2 | | Education and that promotes equitable access, informed |
| 3 | | decision-making, and nondiscriminatory practices: |
| 4 | | (1) A meeting between the student, the student's |
| 5 | | parent or guardian, and an appropriately licensed school |
| 6 | | counselor or other qualified school staff member |
| 7 | | designated by the district, during which the student's |
| 8 | | academic strengths, interests, postsecondary goals, and |
| 9 | | individual circumstances are meaningfully considered using |
| 10 | | a student-centered and culturally responsive approach. |
| 11 | | (2) Written acknowledgment, which may be in an |
| 12 | | electronic form, from both the student and the student's |
| 13 | | parent or guardian, that the student and the student's |
| 14 | | parent or guardian understand the potential impact of |
| 15 | | exempting the student from one or both years of the |
| 16 | | foreign language requirement on postsecondary options, |
| 17 | | including, but not limited to, minimum admission |
| 18 | | requirements for public universities in this State and |
| 19 | | other institutions of higher education, as well as |
| 20 | | alternative pathways that may be available. The |
| 21 | | acknowledgment must also confirm the student's and the |
| 22 | | parent's or guardian's understanding that such an |
| 23 | | exemption may limit eligibility for admission to certain |
| 24 | | institutions or programs and may require adjustment of the |
| 25 | | student's course plan if the student's postsecondary |
| 26 | | goals, interests, or opportunities change. In order for |

| 1 | | the student to be exempted, this acknowledgment needs to |
| 2 | | be completed by the end of the student's 9th grade year. A |
| 3 | | student transferring to the school after the 9th grade |
| 4 | | shall begin the counselor-guided process at the time of |
| 5 | | registration in order to be considered for the exemption. |
| 6 | | (3) A written course plan, developed collaboratively |
| 7 | | with the student, that identifies the coursework the |
| 8 | | student will complete in lieu of the foreign language |
| 9 | | requirement and that supports the student's individualized |
| 10 | | college and career goals, maintains academic rigor, and |
| 11 | | aligns with postsecondary-readiness expectations |
| 12 | | established by the State Board of Education. |
| 13 | | A student who has used the counselor-guided process may |
| 14 | | not be prohibited from enrolling in foreign language |
| 15 | | coursework in a subsequent school year. The school district |
| 16 | | shall, to the extent practicable, provide equitable access to |
| 17 | | foreign language instruction and appropriate academic support |
| 18 | | to enable the student to meet postsecondary admission |
| 19 | | requirements if the student's goals change. |
| 20 | | Nothing in this subsection may be construed to limit a |
| 21 | | student's ability to earn credits through foreign language |
| 22 | | coursework, demonstrate proficiency, or satisfy other |
| 23 | | graduation requirements through allowable substitutions under |
| 24 | | this Code. This subsection may not be implemented in a manner |
| 25 | | that results in a disparate impact on any student group or that |
| 26 | | conflicts with State Board of Education equity, access, or |

| 1 | | postsecondary-readiness guidance. |
| 2 | | Implementation of the counselor-guided process, the |
| 3 | | development or modification of a student's course plan, and a |
| 4 | | student's enrollment or reenrollment in foreign language |
| 5 | | coursework pursuant to this subsection shall be carried out in |
| 6 | | accordance with the school district's existing course |
| 7 | | offerings and scheduling constraints and may not be construed |
| 8 | | to waive, eliminate, or otherwise alter the 2-year foreign |
| 9 | | language requirement under clause (i) of subsection (e-10), |
| 10 | | except as expressly provided through an approved exemption |
| 11 | | pursuant to this subsection.". |
