2    AMENDMENT NO. ______. Amend Senate Bill 3048 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Freedom of Information Act is amended by
5changing Section 7.5 as follows:

9    Sec. 7.5. Statutory exemptions. To the extent provided for
10by the statutes referenced below, the following shall be
11exempt from inspection and copying:
12        (a) All information determined to be confidential
13    under Section 4002 of the Technology Advancement and
14    Development Act.
15        (b) Library circulation and order records identifying
16    library users with specific materials under the Library

8        (d) Information and records held by the Department of
9    Public Health and its authorized representatives relating
10    to known or suspected cases of sexually transmitted
11    infection or any information the disclosure of which is
12    restricted under the Illinois Sexually Transmitted
13    Infection Control Act.
14        (e) Information the disclosure of which is exempted
15    under Section 30 of the Radon Industry Licensing Act.
16        (f) Firm performance evaluations under Section 55 of
17    the Architectural, Engineering, and Land Surveying

19        (g) Information the disclosure of which is restricted
20    and exempted under Section 50 of the Illinois Prepaid
21    Tuition Act.
22        (h) Information the disclosure of which is exempted
23    under the State Officials and Employees Ethics Act, and
24    records of any lawfully created State or local inspector
25    general's office that would be exempt if created or

2        (i) Information contained in a local emergency energy
3    plan submitted to a municipality in accordance with a
4    local emergency energy plan ordinance that is adopted

7    of surcharge moneys collected and remitted by carriers
8    under the Emergency Telephone System Act.
9        (k) Law enforcement officer identification information
10    or driver identification information compiled by a law
11    enforcement agency or the Department of Transportation
12    under Section 11-212 of the Illinois Vehicle Code.
13        (l) Records and information provided to a residential
14    health care facility resident sexual assault and death
15    review team or the Executive Council under the Abuse
16    Prevention Review Team Act.
17        (m) Information provided to the predatory lending
18    database created pursuant to Article 3 of the Residential
19    Real Property Disclosure Act, except to the extent
20    authorized under that Article.
21        (n) Defense budgets and petitions for certification of
22    compensation and expenses for court appointed trial
23    counsel as provided under Sections 10 and 15 of the
24    Capital Crimes Litigation Act (repealed). This subsection
25    (n) shall apply until the conclusion of the trial of the
26    case, even if the prosecution chooses not to pursue the

2        (o) Information that is prohibited from being

14    Real Property Disclosure Act, except to the extent
15    authorized under that Article.
16        (n) Defense budgets and petitions for certification of
17    compensation and expenses for court appointed trial
18    counsel as provided under Sections 10 and 15 of the
19    Capital Crimes Litigation Act (repealed). This subsection
20    (n) shall apply until the conclusion of the trial of the
21    case, even if the prosecution chooses not to pursue the
22    death penalty prior to trial or sentencing.
23        (o) Information that is prohibited from being
24    disclosed under Section 4 of the Illinois Health and
25    Hazardous Substances Registry Act.

15    Section 10. The Illinois Domestic Violence Act of 1986 is
16amended by changing Section 301.1 and by adding Section 307 as
17follows:

19    Sec. 301.1. Law enforcement policies.
20    (a) Every law enforcement agency shall develop, adopt, and
21implement written policies regarding arrest procedures for
22domestic violence incidents consistent with the provisions of
23this Act. In developing these policies, each law enforcement
24agency shall consult with community organizations and other

1law enforcement agencies with expertise in recognizing and
2handling domestic violence incidents.
3    (b) In the initial training of new recruits and every 5
4years in the continuing education of law enforcement officers,
5every law enforcement agency shall provide training to aid in
6understanding the actions of domestic violence victims and
7abusers and to prevent further victimization of those who have
8been abused, focusing specifically on looking beyond the
9physical evidence to the psychology of domestic violence
10situations, such as the dynamics of the aggressor-victim
11relationship, separately evaluating claims where both parties
12claim to be the victim, and long-term effects.
13    Beginning January 1, 2029, for law enforcement agencies
14using lethality assessments, the continuing education should
15include training on policies and procedures for administering
16a lethality assessment.
17    The Law Enforcement Training Standards Board shall
18formulate and administer the training under this subsection
19(b) as part of the current programs for both new recruits and
20active law enforcement officers. The Board shall formulate the
21training by July 1, 2017, and implement the training statewide
22by July 1, 2018. In formulating the training, the Board shall
23work with community organizations with expertise in domestic
24violence to determine which topics to include. The Law
25Enforcement Training Standards Board shall oversee the
26implementation and continual administration of the training.

3    Sec. 307. Domestic violence lethality assessments. By
4January 1, 2028, the Department of Human Services, in
5cooperation with the Illinois State Police, shall create a
6domestic violence lethality tool kit for use by law
7enforcement agencies. As part of this effort, the Illinois
8State Police and Department may engage with groups, including,
9but not limited to, a statewide association representing
10sheriffs, a statewide association representing chiefs of
11police, a statewide association representing State's
12Attorneys, a statewide association dedicated to domestic
13violence prevention that includes survivor voices, and an
14association working with victims' rights to review and provide
15feedback on a template. Stakeholder feedback shall be gathered
16and analyzed by August 1, 2027. Based on this feedback, model
17policies and protocols shall be developed that law enforcement
18agencies may use or reference in developing their domestic
19violence lethality assessment template, policies, protocols,
20training, and referrals to domestic violence services. Nothing
21in this Section imposes any additional liability on a law
22enforcement officer or agency acting in good faith
23administering these assessments.
 
24    Section 95. No acceleration or delay. Where this Act makes

1changes in a statute that is represented in this Act by text
2that is not yet or no longer in effect (for example, a Section
3represented by multiple versions), the use of that text does
4not accelerate or delay the taking effect of (i) the changes
