AMENDMENT TO SENATE BILL 3020

2    AMENDMENT NO. ______. Amend Senate Bill 3020 by replacing
3line 3 on page 3 through line 2 on page 5 with the following:
4            "(ii) repeatedly telephoning or electronically
5        contacting the petitioner's place of employment, home,
6        mobile phone, or residence or otherwise repeatedly
7        contacting the petitioner, including through a third
8        party, by any means repeatedly telephoning
9        petitioner's place of employment, home or residence;
10            (iii) repeatedly following the petitioner about in
11        a public place or places;
12            (iv) repeatedly keeping the petitioner under
13        surveillance by remaining present outside his or her
14        home, school, place of employment, vehicle, or other
15        place occupied by the petitioner or by peering in the
16        petitioner's windows;
17            (iv-5) using electronic means to repeatedly track,
18        monitor, surveil, record, or otherwise acquire

1        information about the petitioner's location, movement,
2        or travel patterns, including through third parties;
3            (v) improperly concealing a minor child from the
4        petitioner, repeatedly threatening to improperly
5        remove a minor child of the petitioner's from the
6        jurisdiction or from the physical care of the
7        petitioner, repeatedly threatening to conceal a minor
8        child from the petitioner, or making a single such
9        threat following an actual or attempted improper
10        removal or concealment, unless the respondent was
11        fleeing from an incident or pattern of domestic
12        violence; or
13            (vi) threatening physical force, confinement or
14        restraint on one or more occasions; .
15            (vii) non-consensual dissemination or threatening
16        the non-consensual dissemination of electronically
17        generated or altered content using the image, voice,
18        or other characteristic of the petitioner to falsely
19        and deceptively impersonate the petitioner or the
20        petitioner's representative;
21            (viii) non-consensual dissemination or threatening
22        the non-consensual dissemination of private sexual
23        images or electronically altered sexual images of the
24        petitioner; or
25            (ix) publishing the personally identifiable
26        information of the petitioner."; and

1on page 7, immediately below line 4, by inserting the
2following:
3        "(1.5) "Electronic" means relating to technology
4    having electrical, digital, magnetic, wireless, networked,
5    optical, electromagnetic, global positioning system, or
6    similar capabilities."; and
 
7on page 42, by deleting lines 17 through 24; and
 
8on page 42, line 25, by replacing "(20)" with "(19)"; and
 
9on page 47, immediately below line 24, by inserting the
10following:
11    "(4.5) "Electronic" means relating to technology having
12electrical, digital, magnetic, wireless, networked, optical,
13electromagnetic, global positioning system, or similar
14capabilities."; and
 
15by replacing line 11 on page 49 through line 5 on page 51 with
16the following:
17        "(ii) repeatedly telephoning or electronically
18    contacting the petitioner's place of employment, home,
19    mobile phone, or residence or otherwise repeatedly
20    contacting the petitioner, including through a third
21    party, by any means repeatedly telephoning petitioner's

2        (iii) repeatedly following the petitioner about in a
3    public place or places;
4        (iv) repeatedly keeping the petitioner under

7    occupied by the petitioner or by peering in the
8    petitioner's windows;
9        (iv-5) using electronic means to repeatedly track,
10    monitor, surveil, record, or otherwise acquire information
11    about the petitioner's location, movement, or travel
12    patterns, including through third parties;
13        (v) improperly concealing a minor child from the
14    petitioner, repeatedly threatening to improperly remove a
15    minor child of the petitioner's from the jurisdiction or
16    from the physical care of the petitioner, repeatedly
17    threatening to conceal a minor child from the petitioner,
18    or making a single such threat following an actual or
19    attempted improper removal or concealment, unless the
20    respondent was fleeing an incident or pattern of domestic
21    violence; or
22        (vi) threatening physical force, confinement or
23    restraint on one or more occasions; .
24        (vii) non-consensual dissemination or threatening the
25    non-consensual dissemination of electronically generated
26    or altered content using the image, voice, or other

1    characteristic of the petitioner to falsely and
2    deceptively impersonate the petitioner or the petitioner's
3    representative;
4        (viii) non-consensual dissemination or threatening the
5    non-consensual dissemination of private sexual images or
6    electronically altered sexual images of the petitioner; or
7        (ix) publishing the personally identifiable
8    information of the petitioner."; and
 
9on page 88, by deleting lines 9 through 16; and
 
10on page 88, line 17, by replacing "(20)" with "(19)".
