| 4 | | "Section 5. The Mental Health and Developmental |
| 5 | | Disabilities Code is amended by changing Section 1-129 and by |
| 6 | | adding Section 1-100.1 as follows:

| 7 | | (405 ILCS 5/1-100.1 new) |
| 8 | | Sec. 1-100.1. Nothing in this Act shall be construed to |
| 9 | | prohibit the diagnosis or treatment of clinically significant |
| 10 | | distress related to gender identity, including gender |
| 11 | | dysphoria.

| 13 | | Sec. 1-129. Mental illness. "Mental illness" means a |
| 14 | | mental, or emotional disorder that substantially impairs a |
| 15 | | person's thought, perception of reality, emotional process, |
|

| 1 | | judgment, behavior, or ability to cope with the ordinary |
| 2 | | demands of life, but does not include a developmental |
| 3 | | disability, dementia or Alzheimer's disease absent psychosis, |
| 4 | | a substance use disorder, or an abnormality manifested only by |
| 5 | | repeated criminal or otherwise antisocial conduct. "Mental |
| 6 | | illness" also does not include: (i) identifying as having a |
| 7 | | non-heterosexual "sexual orientation" as defined in subsection |
| 8 | | (O-1) of Section 1-103 of the Illinois Human Rights Act; (ii) |
| 9 | | engaging in consensual sexual activity, including consensual |
| 10 | | same-sex sexual activity; (iii) seeking to affirm or express |
| 11 | | one's gender identity, including, but not limited to, |
| 12 | | identifying as transgender, non-binary, or |
| 13 | | gender-non-conforming; (iv) adorning or styling one's body, |
| 14 | | face, or hair in a way not aligned with gender stereotypes; or |
| 15 | | (v) having a housing status as that term is defined in Section |
| 16 | | 10 of the Bill of Rights for the Homeless Act. |
