AMENDMENT TO SENATE BILL 415

2    AMENDMENT NO. ______. Amend Senate Bill 415, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 1, on page 2, by replacing line 19 with the following:
5"for legitimate instructional purposes, as determined by the
6school district. Within the context of the legitimate
7instructional purposes, the use of biometric information shall
8be solely for identification or fraud prevention. Biometric
9systems incorporated into school-issued electronic devices for
10identification or fraud prevention constitute a legitimate
11instructional purpose under this Section.
12    The provisions of subsection (a-5) and this subsection
13(a-10) regarding the use of biometric information for purposes
14other than legitimate instructional purposes shall not affect
15any existing contractual obligation under a contract entered
16into before January 1, 2027 between a school district and any
17entity for the purpose of obtaining, collecting, processing,
18storing, transmitting, displaying, or otherwise handling

1biometric information, as long as the contract is not extended
2or rolled over if the contract may be extended or rolled over.
3A school district that has entered into a contract with an
4entity for the purpose of obtaining, collecting, processing,
5storing, transmitting, displaying, or otherwise handling
6biometric information before January 1, 2027 shall provide a
7written notice, by the 2027-2028 school year, to the
8individual having legal custody of the student or to the
9student if he or she has reached the age of 18 of the existing
10option to discontinue the use of the student's biometric
11information under subparagraph (B) of paragraph (2) of
12subsection (b). Any provision of a contract between an entity
13and a school district for the purpose of obtaining,
14collecting, processing, storing, transmitting, displaying, or
15otherwise handling biometric information entered into on or
16after January 1, 2027 that conflicts with this Section is
17void."; and
 
18on page 3, line 15, by replacing "The" with "Within the context
