HOUSE JOINT RESOLUTION

 
2    WHEREAS, The Illinois Department of Children and Family
3Services (DCFS) partners with community-based organizations to
4provide foster care services for nearly 70% of the youth in
5care, over 13,000 children, in Illinois; and
 
6    WHEREAS, To contract with the State to provide these vital
7services, foster care providers are required to maintain
8adequate liability insurance, but foster care agencies are
9struggling to get quality and effective liability insurance
10coverage and are unable to continue providing these vital
11services to the youth and families under their care; and
 
12    WHEREAS, The remaining two major insurance carriers have
13publicly announced that they will not be writing any new
14policies in 2025 and will be renewing existing policies on a
15case-by-case basis with many providers renewing at exorbitant
16increases to premiums and significant reductions in coverage;
17and
 
18    WHEREAS, Without a viable alternative for liability
19insurance, foster care agencies are preparing to transfer
20hundreds of foster youth to DCFS; and
 
21    WHEREAS, Under normal circumstances, DCFS is able to

1transition services to another agency when a foster care
2provider discontinues providing services; and
 
3    WHEREAS, Without certainty that insurance coverage will be
4renewed, DCFS will be unable to transition services to another
5agency unable to absorb foster youth and/or families from
6other agencies without significantly jeopardizing their own
7coverage; and
 
8    WHEREAS, Foster care agencies will be forced to scale back
9or discontinue foster care services entirely due to
10inaccessible liability insurance coverage as there are
11currently no State plans for transition services for the
12thousands of already trauma-exposed children in the system;
13and
 
14    WHEREAS, The foster care system will experience
15disruptions that will result in the transfer of foster youth
16to the direct supervision of DCFS, increased lengths of stay
17for foster youth, loss of foster families, and additional
18budgetary constraints on DCFS and any remaining foster care
19agencies; therefore, be it
 
20    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
21HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
22SENATE CONCURRING HEREIN, that the Child Welfare Agency

1Liability Task Force is created to develop and recommend a
2permanent solution to address the unavailability of liability
3insurance for child welfare agencies in the State; and be it
4further
 
5    RESOLVED, That the Task Force shall consist of the
6following members, who shall serve without compensation:
7        (1) The Director of Department of Insurance or his or
8    her designee, who shall serve as chair;
9        (2) One member of the House of Representatives
10    appointed by the Speaker of the House;
11        (3) One member of the House of Representatives
12    appointed by the Minority Leader of the House;
13        (4) One member of the Senate appointed by the Senate
14    President;
15        (5) One member of the Senate appointed by the Minority
16    Leader of the Senate;
17        (6) The Director of the Department of Children and
18    Family Services or his or her designee;
19        (7) One representative from the insurance industry
20    with expertise in liability coverage appointed by the
21    Governor;
22        (8) One representative from a statewide organization
23    that advocates on behalf of Illinois attorneys appointed
24    by the Governor; and
25        (9) One representative from a statewide organization

1    that advocates on behalf of the community-based services
2    for children and families appointed by the Governor; and
3    be it further
 
4    RESOLVED, That initial appointments to the Task Force
5shall be made no more than three months after adoption of this
6resolution; and be it further
 
7    RESOLVED, That if a vacancy occurs in the Task Force
8membership, it shall be filled in the same manner as the
9original appointment; and be it further
 
10    RESOLVED, That the Illinois Department of Insurance and
11the Illinois Department of Children and Family Services shall
12provide administrative support for the Task Force; and be it
13further
 
14    RESOLVED, That the Task Force shall hold its first meeting
15within 30 days after all Task Force members have been
16appointed and then on a monthly basis thereafter; and be it
17further
 
18    RESOLVED, That the Task Force shall submit its final
19report to the General Assembly no later than December 31,
202026, and upon filing of the report, the Task Force is
21dissolved; and be it further

1    RESOLVED, That suitable copies of this resolution be
2delivered to the Speaker of the House, the Minority Leader of
3the House, the Senate President, the Minority Leader of the
4Senate, the Director of Department of Insurance, the Director
5of Children and Family Services, and the Governor.
