| 1 | HOUSE JOINT RESOLUTION | ||||||
| 2 | WHEREAS, The Illinois Department of Children and Family | ||||||
| 3 | Services (DCFS) partners with community-based organizations to | ||||||
| 4 | provide foster care services for nearly 70% of the youth in | ||||||
| 5 | care, over 13,000 children, in Illinois; and | ||||||
| 6 | WHEREAS, To contract with the State to provide these vital | ||||||
| 7 | services, foster care providers are required to maintain | ||||||
| 8 | adequate liability insurance, but foster care agencies are | ||||||
| 9 | struggling to get quality and effective liability insurance | ||||||
| 10 | coverage and are unable to continue providing these vital | ||||||
| 11 | services to the youth and families under their care; and | ||||||
| 12 | WHEREAS, The remaining two major insurance carriers have | ||||||
| 13 | publicly announced that they will not be writing any new | ||||||
| 14 | policies in 2025 and will be renewing existing policies on a | ||||||
| 15 | case-by-case basis with many providers renewing at exorbitant | ||||||
| 16 | increases to premiums and significant reductions in coverage; | ||||||
| 17 | and | ||||||
| 18 | WHEREAS, Without a viable alternative for liability | ||||||
| 19 | insurance, foster care agencies are preparing to transfer | ||||||
| 20 | hundreds of foster youth to DCFS; and | ||||||
| 21 | WHEREAS, Under normal circumstances, DCFS is able to | ||||||
| |||||||
| |||||||
| 1 | transition services to another agency when a foster care | ||||||
| 2 | provider discontinues providing services; and | ||||||
| 3 | WHEREAS, Without certainty that insurance coverage will be | ||||||
| 4 | renewed, DCFS will be unable to transition services to another | ||||||
| 5 | agency unable to absorb foster youth and/or families from | ||||||
| 6 | other agencies without significantly jeopardizing their own | ||||||
| 7 | coverage; and | ||||||
| 8 | WHEREAS, Foster care agencies will be forced to scale back | ||||||
| 9 | or discontinue foster care services entirely due to | ||||||
| 10 | inaccessible liability insurance coverage as there are | ||||||
| 11 | currently no State plans for transition services for the | ||||||
| 12 | thousands of already trauma-exposed children in the system; | ||||||
| 13 | and | ||||||
| 14 | WHEREAS, The foster care system will experience | ||||||
| 15 | disruptions that will result in the transfer of foster youth | ||||||
| 16 | to the direct supervision of DCFS, increased lengths of stay | ||||||
| 17 | for foster youth, loss of foster families, and additional | ||||||
| 18 | budgetary constraints on DCFS and any remaining foster care | ||||||
| 19 | agencies; therefore, be it | ||||||
| 20 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
| 21 | HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | ||||||
| 22 | SENATE CONCURRING HEREIN, that the Child Welfare Agency | ||||||
| |||||||
| |||||||
| 1 | Liability Task Force is created to develop and recommend a | ||||||
| 2 | permanent solution to address the unavailability of liability | ||||||
| 3 | insurance for child welfare agencies in the State; and be it | ||||||
| 4 | further | ||||||
| 5 | RESOLVED, That the Task Force shall consist of the | ||||||
| 6 | following members, who shall serve without compensation: | ||||||
| 7 | (1) The Director of Department of Insurance or his or | ||||||
| 8 | her designee, who shall serve as chair; | ||||||
| 9 | (2) One member of the House of Representatives | ||||||
| 10 | appointed by the Speaker of the House; | ||||||
| 11 | (3) One member of the House of Representatives | ||||||
| 12 | appointed by the Minority Leader of the House; | ||||||
| 13 | (4) One member of the Senate appointed by the Senate | ||||||
| 14 | President; | ||||||
| 15 | (5) One member of the Senate appointed by the Minority | ||||||
| 16 | Leader of the Senate; | ||||||
| 17 | (6) The Director of the Department of Children and | ||||||
| 18 | Family Services or his or her designee; | ||||||
| 19 | (7) One representative from the insurance industry | ||||||
| 20 | with expertise in liability coverage appointed by the | ||||||
| 21 | Governor; | ||||||
| 22 | (8) One representative from a statewide organization | ||||||
| 23 | that advocates on behalf of Illinois attorneys appointed | ||||||
| 24 | by the Governor; and | ||||||
| 25 | (9) One representative from a statewide organization | ||||||
| |||||||
| |||||||
| 1 | that advocates on behalf of the community-based services | ||||||
| 2 | for children and families appointed by the Governor; and | ||||||
| 3 | be it further | ||||||
| 4 | RESOLVED, That initial appointments to the Task Force | ||||||
| 5 | shall be made no more than three months after adoption of this | ||||||
| 6 | resolution; and be it further | ||||||
| 7 | RESOLVED, That if a vacancy occurs in the Task Force | ||||||
| 8 | membership, it shall be filled in the same manner as the | ||||||
| 9 | original appointment; and be it further | ||||||
| 10 | RESOLVED, That the Illinois Department of Insurance and | ||||||
| 11 | the Illinois Department of Children and Family Services shall | ||||||
| 12 | provide administrative support for the Task Force; and be it | ||||||
| 13 | further | ||||||
| 14 | RESOLVED, That the Task Force shall hold its first meeting | ||||||
| 15 | within 30 days after all Task Force members have been | ||||||
| 16 | appointed and then on a monthly basis thereafter; and be it | ||||||
| 17 | further | ||||||
| 18 | RESOLVED, That the Task Force shall submit its final | ||||||
| 19 | report to the General Assembly no later than December 31, | ||||||
| 20 | 2026, and upon filing of the report, the Task Force is | ||||||
| 21 | dissolved; and be it further | ||||||

| 1 | RESOLVED, That suitable copies of this resolution be | ||||||
| 2 | delivered to the Speaker of the House, the Minority Leader of | ||||||
| 3 | the House, the Senate President, the Minority Leader of the | ||||||
| 4 | Senate, the Director of Department of Insurance, the Director | ||||||
| 5 | of Children and Family Services, and the Governor. | ||||||
