| 2 | | AMENDMENT NO. ______. Amend House Bill 5390 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Fair Patient Billing Act is amended by |
| 5 | | changing Section 27 as follows: |

| 7 | | Sec. 27. Application procedures for financial assistance |
| 8 | | Procedures for Financial Assistance. |
| 9 | | (a) Applications. The Attorney General shall, by rule, |
| 10 | | adopt standard provisions for a uniform financial assistance |
| 11 | | form to be included in all applications for financial |
| 12 | | assistance no later than June 30, 2013. On or before December |
| 13 | | 31, 2026, interested stakeholders January 1, 2013, a statewide |
| 14 | | association representing a majority of hospitals may submit to |
| 15 | | the Attorney General recommendations concerning a uniform |
| 16 | | standard provisions to be used in an application for financial |

| 1 | | assistance, and the Attorney General shall take reasonably |
| 2 | | relevant those recommendations into account when adopting |
| 3 | | rules under this subsection. |
| 4 | | Approval of eligibility for financial assistance is valid for |
| 5 | | at least 12 months after the first service date for which the |
| 6 | | patient submitted a financial assistance application, pursuant |
| 7 | | to the hospital's financial assistance policy and subject to |
| 8 | | subsection (b) of Section 45. A hospital must use only a |
| 9 | | uniform financial assistance form developed and provided by |
| 10 | | the Attorney General. |
| 11 | | (b) Presumptive eligibility Eligibility. The Attorney |
| 12 | | General shall, by rule, adopt appropriate methodologies for |
| 13 | | the determination of presumptive eligibility no later than |
| 14 | | June 30, 2013. On or before January 1, 2013, a statewide |
| 15 | | association representing a majority of hospitals may submit to |
| 16 | | the Attorney General recommendations concerning those |
| 17 | | methodologies, and the Attorney General shall take those |
| 18 | | recommendations into account when adopting rules under this |
| 19 | | subsection. |

| 21 | | Section 99. Effective date. This Act takes effect upon |
| 22 | | becoming law.". |
