AMENDMENT TO HOUSE BILL 5243

2    AMENDMENT NO. ______. Amend House Bill 5243 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Township Code is amended by adding Section
5235-30 as follows:
 
6    (60 ILCS 1/235-30 new)
7    Sec. 235-30. Tentative budget and appropriation ordinance
8and tax for road purposes for townships in counties of more
9than 250,000 inhabitants. In each road district composed of a
10single township:
11        (1) The township board must hold a public hearing
12    before adopting a budget and appropriation ordinance for
13    road purposes.
14        (2) The township board must, at least 30 days before a
15    public hearing, prepare or cause to be prepared a
16    tentative budget and appropriation ordinance for road

1    purposes and file the ordinance with the township clerk.
2    The township clerk must make the tentative budget and
3    appropriation ordinance for road purposes available for
4    public inspection for at least 30 days before final action
5    on the ordinance. The required public hearing must be held
6    on or before the last day of the first quarter of the
7    fiscal year before the township board. Notice of the
8    hearing must be given by publication in a newspaper
9    published in the township at least 30 days before the time
10    of the hearing. If there is no newspaper published in the
11    township, notice of the public hearing may be given by
12    posting notices in 5 of the most public places in the
13    township. It is the duty of the township clerk to arrange
14    for the public hearing.
15        (3) The township board may adopt all or part of a
16    tentative budget and appropriation ordinance for road
17    purposes, as the township board deems necessary, and shall
18    levy the amount determined by the board and certify to the
19    county clerk the amount necessary to be raised by taxation
20    for road purposes as provided in Section 6-501 of the
21    Illinois Highway Code.
 
22    Section 10. The Illinois Highway Code is amended by
23changing Section 6-207 as follows:

1    Sec. 6-207. Compensation of highway commissioner and other
2officers.
3    (a) Unless an annual salary is fixed as provided in this
4Section, the highway commissioner shall receive for each day
5he or she is necessarily employed in the discharge of official
6duties a per diem to be fixed by the county board in road
7districts in counties not under township organization, by the
8highway board of trustees in consolidated township road
9districts, and by the board of town trustees in districts
10composed of a single township. Before any per diem is paid, a
11sworn statement shall be filed by the commissioner in the
12office of the district clerk, showing the number of days the
13commissioner was employed, the kind of employment, and the
14dates of employment.
15    The boards specified in the preceding paragraph may,
16instead of a per diem, fix an annual salary for the highway
17commissioner at not less than $3,000, to be paid in equal
18monthly installments. The boards shall fix the compensation of
19the commissioner, whether an annual salary or a per diem, on or
20before the last Tuesday in March before the date of election of
21the commissioner.
22    If the term of any highway commissioner is extended by
23operation of law, the board that fixes the commissioner's rate
24of compensation may increase the rate of the compensation,
25within the limits provided in this Section, in relation to
26that portion of the commissioner's term that extends beyond

1the period for which he or she was elected.
2    The board of town trustees shall order payment of the
3amount of per diem claimed in the highway commissioner's sworn
4statement at the first regular meeting following the filing of
5the statement. In consolidated township road districts, the
6compensation and the expenses of the offices of the highway
7commissioner, district clerk, and district treasurer shall be
8audited by the highway board of trustees.
9    The compensation of the highway commissioner shall be paid
10from the general township fund in districts composed comprised
11of a single township and shall be paid from the regular road
12fund in all other districts having highway commissioners;
13however, in districts composed comprised of a single township,
14a portion (not exceeding 50%) of the highway commissioner's
15salary shall may be paid from the corporate road and bridge
16fund or the permanent road fund or both if approved by the
17township board and the highway commissioner.
18    (b) The officers composing the highway board of trustees
19in consolidated township road districts shall be entitled to
20$3 per day for attending meetings of the board, to be paid out
21of the town fund of their respective townships. In
22consolidated township road districts, the compensation of the
23district clerk and the district treasurer shall be paid out of
24the road fund of the district.
25    (c) The district clerk shall receive:
26        (1) for each day he or she is necessarily employed in

1    the discharge of official duties, a per diem to be fixed by
2    the county board in road districts in counties not under
3    township organization and by the highway board of trustees
4    in consolidated township road districts; or
5        (2) $4 per day for each day he or she shall be required
6    to meet with the highway commissioner and the same amount
7    per day for the time he or she shall be employed in
8    canvassing the returns of elections. The district clerk
9    shall receive no other per diem. In addition to the above,
10    the district clerk shall also receive fees for the
11    following services, to be paid out of the district road
12    fund, except where otherwise specified:
13            (A) For serving notice of election or appointment
14        upon district officers as required by this Code, 25
15        cents each.
16            (B) For posting up notices required by law, 25
17        cents each.
18            (C) For copying any record in the district clerk's
19        office and certifying to the copy, 10 cents for every
20        100 words, to be paid by the person applying for the
21        certified copy.
22    (d) Except as otherwise provided in this Code, the
23district treasurer shall, in addition to any other
24compensation to which he or she is by law entitled, receive an
25annual salary of not less than $100 nor more than $1,000 per
26year to be fixed by the highway board of trustees in

1consolidated township road districts and by the board of town
2trustees in districts composed of a single township.
3    Except as otherwise provided in this Code, the district
4treasurer shall, in addition to any other compensation to
5which he or she is by law entitled, receive an annual salary
6deemed appropriate and to be fixed by the county board in road
7districts in counties not under township organization.
8    The compensation of the district treasurer shall be paid
9from the general township fund in districts composed of a
10single township and shall be paid from the regular road fund in
11all other districts having district treasurers.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
