AMENDMENT TO HOUSE BILL 4979

2    AMENDMENT NO. ______. Amend House Bill 4979 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Preventing Sexual Violence in Higher
5Education Act is amended by changing Section 35 as follows:
 
6    (110 ILCS 155/35)
7    Sec. 35. Sexual misconduct climate survey.
8    (a) As used in this Section:
9    "Base survey" means a base set of common questions
10recommended by the Task Force on Campus Sexual Misconduct
11Climate Surveys and approved by the Executive Director of the
12Board of Higher Education and Executive Director of the
13Illinois Community College Board.
14    "Student" means a person who is enrolled in a public or
15private degree-granting, post-secondary higher education
16institution, whether part-time, full-time, or as an extension

1student, including any person who has taken a leave of absence
2or who has withdrawn from the higher education institution due
3to being a victim of sexual misconduct.
4    "Trauma informed" means an understanding of the
5complexities of sexual violence, domestic violence, dating
6violence, or stalking through training centered on the
7neurobiological impact of trauma, the influence of societal
8myths and stereotypes surrounding sexual violence, domestic
9violence, dating violence, or stalking, and understanding the
10behavior of perpetrators.
11    (b) Beginning after the effective date of this amendatory
12Act of the 104th General Assembly, each higher education
13institution shall biennially conduct a sexual misconduct
14climate survey of all students at the institution. Each higher
15education institution's sexual misconduct climate survey shall
16include the base survey, which the Board of Higher Education
17or Illinois Community College Board, whichever is applicable,
18shall provide to the institution every 2 years. Each
19institution may append its own campus-specific questions to
20the base survey if questions do not require the disclosure of
21any personally identifying information by the students and are
22trauma informed. The Board of Higher Education and Illinois
23Community College Board, in consultation with the Office of
24the Attorney General, as necessary, shall review any
25complaints submitted by students who believe that questions
26included in the campus sexual misconduct climate survey are

1traumatizing. Within 120 days after completion of a sexual
2misconduct climate survey, but no later than one year after
3the Board of Higher Education or Illinois Community College
4Board, whichever is applicable, issued the last base survey,
5each institution shall compile a summary of the results of the
6sexual misconduct climate survey, including, but not limited
7to, the complete aggregated results for each base survey
8question, and shall submit the summary to the Board of Higher
9Education or Illinois Community College Board, as well as
10publish the summary on the institution's website in an easily
11accessible manner.
12    (c) The Task Force on Campus Sexual Misconduct Climate
13Surveys is created. The Task Force shall consist of the
14following members:
15        (1) the Executive Director of the Board of Higher
16    Education or a designee, who shall serve as chairperson;
17        (2) the Governor or a designee;
18        (3) one member of the Senate, appointed by the
19    President of the Senate;
20        (4) one member of the House of Representatives,
21    appointed by the Speaker of the House of Representatives;
22        (5) one member of the Senate, appointed by the
23    Minority Leader of the Senate;
24        (6) one member of the House of Representatives,
25    appointed by the Minority Leader of the House of
26    Representatives;

1        (7) the Attorney General or a designee;
2        (8) the Director of Public Health or a designee;
3        (9) the Executive Director of the Illinois Community
4    College Board or a designee;
5        (10) the following members appointed by the Board of
6    Higher Education:
7            (A) one member who is a student attending a public
8        higher education institution in Illinois;
9            (B) one member who is a student attending a
10        private higher education institution in Illinois;
11            (C) one member who is a representative of the
12        University of Illinois recommended by the president of
13        the university;
14            (D) one member who is a representative of private
15        colleges and universities recommended by the
16        Federation of Independent Illinois Colleges and
17        Universities;
18            (E) one member who is a chief student service
19        officer at a public or private university; and
20            (F) one member with expertise in institutional
21        research within a 4-year institution of higher
22        education;
23        (11) the following members appointed by the Illinois
24    Community College Board:
25            (A) one member who is a student attending a
26        community college in Illinois;

1            (B) one member who is a representative of the
2        community college system recommended by the Illinois
3        Council of Community College Presidents;
4            (C) one member who is a chief student service
5        office at a community college;
6            (D) one member with expertise in institutional
7        research within a 2-year institution of higher
8        education; and
9        (12) the following members appointed by the Governor:
10            (A) (Blank);
11            (B) (Blank);
12            (C) (Blank);
13            (D) (Blank);
14            (E) (Blank);
15            (F) (Blank);
16            (G) 3 members who are representatives of survivors
17        of sexual assault recommended by the Illinois
18        Coalition Against Sexual Assault, with one
19        specifically representing survivors in rural
20        communities and one specifically representing
21        survivors in urban communities;
22            (H) one member who is a representative of a
23        non-profit legal services organization that provides
24        legal representation to victims of campus sexual
25        assault in Illinois;
26            (I) one member who is a representative recommended

1        by the Illinois Coalition Against Domestic Violence;
2            (J) one member who is a representative recommended
3        by Equality Illinois;
4            (K) one member who is a representative of an
5        immigrant rights advocacy organization;
6            (L) one member who is a representative recommended
7        by the Every Voice Coalition or any successor
8        organization of the Every Voice Coalition;
9            (M) one member who is a researcher with experience
10        in the development and design of sexual misconduct
11        climate surveys; and
12            (N) one member who is a researcher of statistics,
13        data analytics, or econometrics with experience in
14        higher education survey analysis.
15    The Task Force shall hold its first meeting as soon as
16practicable after the effective date of this amendatory Act of
17the 102nd General Assembly. Administrative and other support
18for the Task Force shall be provided by the Board of Higher
19Education. Members of the Task Force shall serve 2-year terms
20that commence on the date of appointment. Members shall
21continue to serve until their successors are appointed. Any
22vacancy shall be filled by the appointing authority. Any
23vacancy occurring other than by expiration of the term shall
24be filled for the balance of the unexpired term. A majority of
25the Task Force shall constitute a quorum for the transaction
26of any business.

1    Members of the Task Force shall serve without compensation
2but shall be reimbursed for expenses necessarily incurred in
3the performance of their duties if funds are available.
4However, the higher education institution in which a student
5member is enrolled may compensate that student for
6participating on the Task Force through a work-study program
7or by providing a stipend to support the work of the student
8member on the Task Force.
9    (d) The Task Force shall develop and recommend to the
10Board of Higher Education and Illinois Community College Board
11the base survey for distribution to higher education
12institutions and provide the Board of Higher Education and
13Illinois Community College Board with any related
14recommendations regarding the content, timing, and application
15of the base survey. The Task Force shall deliver the base
16survey and related recommendations, including, but not limited
17to, recommendations on achieving statistically valid response
18rates, to the Board of Higher Education and Illinois Community
19College Board no less often than every 2 years and for the
20first time on or before July 31, 2023. Beginning after the
21effective date of this amendatory Act of the 104th General
22Assembly, the Task Force shall meet to recommend updates and
23revisions to the base survey. The Task Force is dissolved
24after the completion of the 2027 base survey. After the
25dissolution of the Task Force, the Executive Director of the
26Board of Higher Education or a designee and the Executive

1Director of the Illinois Community College Board or a designee
2shall review the base survey every 2 years to consider any
3feedback that has been received and to implement improvements.
4    (e) In developing the base survey, the Task Force shall:
5        (1) utilize best practices from peer-reviewed research
6    and consult with individuals with expertise in the
7    development and use of sexual misconduct climate surveys
8    by higher education institutions, specifically the survey
9    design should consider survey length and time to complete,
10    respondent experience, minimization of question
11    redundancy, and question skip logic and branching
12    dependent on the respondent answers;
13        (2) review sexual misconduct climate surveys that have
14    been developed and previously utilized by higher education
15    institutions in Illinois and by other states that mandate
16    campus climate surveys;
17        (3) provide opportunities for written comment from
18    survivors and organizations that work directly with
19    survivors of sexual misconduct to ensure the adequacy and
20    appropriateness of the proposed content;
21        (4) consult with institutions on strategies for
22    optimizing the effectiveness of the survey;
23        (5) account for the diverse needs and differences of
24    higher education institutions; and
25        (6) review the base survey to ensure that the strategy
26    for gathering information is trauma informed.

1    (f) The base survey shall gather information on topics,
2such as including, but not limited to:
3        (1) the number and type of incidents, both reported to
4    the higher education institution and unreported to the
5    higher education institution, of sexual misconduct at the
6    higher education institution;
7        (2) when and where incidents of sexual misconduct
8    occurred, such as on campus, off campus, abroad, or
9    online;
10        (3) student awareness of institutional policies and
11    procedures related to campus sexual misconduct;
12        (4) whether a student reported the sexual misconduct
13    to the higher education institution and, if so, to which
14    campus resource such report was made and, if not, the
15    reason for the student's decision not to report;
16        (5) whether a student reported the sexual misconduct
17    to law enforcement and, if so, to which law enforcement
18    agency such report was made;
19        (6) whether a student was informed of or referred to
20    local, State, campus, or other resources or victim support
21    services, including appropriate medical care, advocacy,
22    counseling, and legal services;
23        (7) whether a student was provided information
24    regarding his or her right to protection from retaliation,
25    access to school-based accommodations, and criminal
26    justice remedies;

1        (8) contextual factors, such as the involvement of
2    force, incapacitation, coercion, or drug or alcohol
3    facilitation;
4        (9) demographic information that could be used to
5    identify at-risk groups, including, but not limited to,
6    gender, race, immigration status, national origin,
7    ethnicity, disability status, sexual orientation, and
8    gender identity;
9        (10) perceptions of campus safety among members of the
10    campus community and confidence in the institution's
11    ability to protect against and respond to incidents of
12    sexual misconduct;
13        (11) whether the student has chosen to withdraw or has
14    taken a leave of absence from the institution or
15    transferred to another institution;
16        (12) whether the student has withdrawn from any
17    classes or has been placed on academic probation as a
18    result of the incident; and
19        (13) other questions as determined by the Task Force.
20All questions on the base survey shall be optional or shall
21offer the student the option to select "I prefer not to answer"
22as a response on the survey.
23    (g) The sexual misconduct climate survey shall collect
24anonymous responses and shall not provide for the public
25disclosure of any personally identifying information. No
26institution may use or attempt to use information collected

1through the sexual misconduct climate survey to identify or
2contact any individual student on campus, nor shall the
3results of the survey be used as the basis for any type of
4investigation or disciplinary or legal proceeding.
5    (h) There shall be established within the Office of the
6Board of Higher Education and the Office of the Illinois
7Community College Board a data repository for all summaries of
8sexual misconduct climate surveys submitted by higher
9education institutions to the Board of Higher Education or
10Illinois Community College Board in accordance with subsection
11(b). The Board of Higher Education and Illinois Community
12College Board shall ensure that the sexual misconduct climate
13survey data submitted by all applicable institutions is
14available to the public in an easily accessible manner on the
15Board of Higher Education's or Illinois Community College
16Board's website.
17    (i) Each higher education institution shall publish on the
18institution's website in an easily accessible manner:
19        (1) the campus level results of the survey;
20        (2) the annual security report required under the
21    federal Jeanne Clery Disclosure of Campus Security Policy
22    and Campus Crime Statistics Act;
23        (3) the reports required under Section 9.21 of the
24    Board of Higher Education Act; and
25        (4) a link to the Board of Higher Education's and
26    Illinois Community College Board's statewide data on

1    sexual misconduct climate survey data as set forth in
2    subsection (h).
3    (j) The Board of Higher Education and Illinois Community
4College Board shall establish rules and procedures, including
5deadlines for dissemination and collection of survey
6information, consistent with the purposes of this Section and
7shall promote effective solicitation to achieve the highest
8practical response rate, collection, and publication of
9statistical information gathered from higher education
10institutions.

13    Section 10. The Board of Higher Education Act is amended

17    (a) The members of the Board whose appointments are
18subject to confirmation by the Senate shall be selected for
196-year terms expiring on January 31 of odd numbered years.
20    (b) The members of the Board shall continue to serve after
21the expiration of their terms until their successors have been
22appointed.
23    (c) Vacancies on the Board in offices appointed by the
24Governor shall be filled by appointment by the Governor for

6beginning on July 1 of each year and serve until a successor is
7appointed and qualified.
8    (e) The member of the Board representing public university
9governing boards and the member of the Board representing
10private college and university boards of trustees, who are
11appointed by the Governor but not subject to confirmation by
12the Senate, shall serve terms of 3 years beginning on July 1.

1    associated with pursuing a degree in that major or program
2    of study.
3        (2) The average monthly student loan payment over a
4    period of 10 20 years based on the estimated cost of his or
5    her education under paragraph (1).
6        (3) The percentage of graduate jobs in which average
7    job placement rate within 12 months after graduation for a
8    graduate who holds a degree in that major or program of
9    study remains continuously employed with the same employer
10    in this State for 3 consecutive fiscal quarters.
11        (4) The average entry-level wage or salary for an
12    occupation related to that major or program of study.
13        (5) The average wage or salary 5 years after entry
14    into an occupation under paragraph (4).

16    Section 60. The Higher Education in Prison Act is amended
17by changing Section 5 as follows:
 
18    (730 ILCS 225/5)
19    Sec. 5. Higher education in prison programs.
20    (a) In this Section, "higher education" means
21post-secondary academic education at the undergraduate or
22graduate level in a community college or university setting.
23    (b) On or before September 1 of the year following the
24effective date of this Act and each subsequent September 1,

1the Department of Corrections shall release a report, to be
2published on the Department of Corrections's Internet website,
3detailing the following information pertaining to higher
4education within Department institutions and facilities:
5        (1) the number of unique individuals involved in adult
6    basic education, high school equivalency, and credit and
7    non-credit bearing higher education programs over the
8    course of the fiscal year;
9        (2) the racial, ethnic, age, and gender breakdown of
10    committed persons participating in higher education
11    programs;
12        (3) the length of sentence and length of remaining
13    sentence of persons enrolled in higher education programs;
14        (4) the number of committed persons who are on waiting
15    lists for participation in all educational programs,
16    including adult basic education, high school equivalency,
17    and higher education, and the average length of time spent
18    on each waiting list, including a breakdown by length of
19    remaining sentence;
20        (5) the total amount of earned program sentence credit
21    awarded to committed persons for participating in higher
22    education programs and the percentage of committed persons
23    participating in higher education programs that are
24    awarded earned program sentence credit;
25        (6) the number, category, and ultimate resolution of
26    grievances related to higher education programs;

1        (7) a financial statement that includes annual and
2    monthly expenditures of Department of Corrections
3    institutions and facilities on adult basic education, high
4    school equivalency, and higher education programs; and
5        (8) an explanation of how participation in adult basic
6    education, high school equivalency, and higher education
7    programs is factored into a committed persons' risk
8    assessment score.
9    Personal, identifiable information shall be redacted to
10protect privacy.
11    The report must be filed with the Governor and General
12Assembly.
13    (c) The data provided in the report under subsection (b)
14shall include an aggregate chart at the Department level and
15individual reports by each correctional institution or
16facility of the Department of Corrections.
17    (d) To facilitate the collection of information on higher
18education in prison (HEP) programs, each 4-year public or
19private institution of higher education with HEP degree or
20certificate programs shall provide the Board of Higher
21Education with student-level information as part of its
22regular agency data-collection processes. Each public
23community college with HEP degree or certificate programs
24shall provide the Illinois Community College Board with
25student-level information as part of its regular agency
26data-collection processes. Upon request, the student-level

1information shall include the correctional facility in which
2the HEP program is being offered. The information provided to
3the Board of Higher Education and the Illinois Community
4College Board shall include HEP enrollment and completion data
5disaggregated by variables, including, but not limited to,
6race, ethnicity, gender, age, and type of degree or
7certificate. The Board of Higher Education and the Illinois
8Community College Board shall annually make HEP program data
9publicly available on their Internet websites, as long as
10public disclosure conforms with State and federal student
11privacy standards and laws. The Board of Higher Education and
12the Illinois Community College Board shall determine the form
13in which HEP program data is made publicly available to
14protect student privacy.
