| 4 | | "Section 5. The Pharmacy Practice Act is amended by adding |
| 5 | | Section 15.2 as follows:

| 6 | | (225 ILCS 85/15.2 new) |
| 7 | | Sec. 15.2. Community pharmacy; supportive staff on site. |
| 8 | | During all times that a community pharmacy remains open for |
| 9 | | the transaction of business, the community pharmacy must: |
| 10 | | (1) have a pharmacist present at the location who is |
| 11 | | working in his or her capacity as a pharmacist; and |
| 12 | | (2) take reasonable steps to ensure that the |
| 13 | | pharmacist-in-charge does not reasonably believe that |
| 14 | | fatigue, distraction, or other conditions are interfering |
| 15 | | with a pharmacist's ability to practice with reasonable |
| 16 | | competence and safety. |
