Synopsis As Introduced
Proposes, under Article V, Section 11 of the Illinois Constitution, to reorganize the Department of Human Services by consolidating and vesting the powers, duties, rights, and responsibilities of the Division of Mental Health and the Division of Substance Use Prevention and Recovery in a new Division of Behavioral Health and Recovery, effective July 1, 2025, or as soon thereafter as practicable. Provides for the transfer of employees from the Division of Mental Health and the Division of Substance Use Prevention and Recovery to the Division of Behavioral Health and Recovery. Specifies that the status and rights of employees are not to be affected by the consolidation. Directs books, records, papers, documents, property (real and personal), contracts, and pending business pertaining to the powers, duties, rights, and responsibilities related to the Division of Mental Health and the Division of Substance Use Prevention and Recovery to be delivered to the Division of Behavioral Health and Recovery. Specifies that any rules, regulations, obligations, and other actions of the Division of Mental Health and the Division of Substance Use Prevention and Recovery are to be transferred and continue as rules, regulations, obligations, and actions of the Division of Behavioral Health and Recovery. Requires the Department of Human Services to modify any rules, regulations, obligations, or other actions, as necessary, to carry out the reorganization. Provides that no obligations arising from any civil or criminal penalties previously imposed are to be affected by the executive order. Specifies that, whenever reports or notices are now required to be made or given or papers or documents furnished or served by any person to or upon the Division of Mental Health or the Division of Substance Use Prevention and Recovery in connection with any of their functions consolidated by the executive order, the same shall be made, given, furnished, or served in the same manner to or upon the new Division of Behavioral Health and Recovery. Provides that the executive order shall not affect any act done, ratified, or canceled or any right occurring or established or any action or proceeding had or commenced in an administrative, civil, or criminal cause regarding the Division of Mental Health or the Division of Substance Use Prevention and Recovery before the executive order takes effect. Authorizes such actions or proceedings to be defended, prosecuted, and continued by the Division of Behavioral Health and Recovery. Contains a savings clause and provisions regarding: prior executive orders; severability; and other matters. Provides that, if neither house of the General Assembly disapproves the executive order, the executive order takes effect 60 days after its delivery to the General Assembly.
