SYNOPSIS AS INTRODUCED:
 

 
ILCON Art. IV, Sec. 16 new

     Amends the Legislature Article of the Illinois Constitution. Provides for a referendum to reject any Public Act by a petition signed by a number of electors. Provides signature and content requirements for the petition. Provides requirements for the validity and sufficiency of petitions. Provides that if a petition is valid and sufficient, the proposed referendum shall be submitted to the electors at the general election specified in the petition. Provides that if the voters in a specified election reject a Public Act, it shall cease to be in effect on the date specified in the referendum. Effective upon being declared adopted.

3    RESOLVED, BY THE SENATE OF THE ONE HUNDRED THIRD GENERAL 
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF 
5REPRESENTATIVES CONCURRING HEREIN, that there shall be 
6submitted to the electors of the State for adoption or 
7rejection at the general election next occurring at least 6 
8months after the adoption of this resolution a proposition to 
9amend Article IV of the Illinois Constitution by adding 
10Section 16 as follows:

14SECTION 16. INITIATIVE TO HOLD A REFERENDUM ON LEGISLATION
15    (a)    A referendum to reject any Public Act, excepting 
16appropriation measures, passed by the General Assembly and 
17enacted into law may be proposed by a petition signed by a 
18number of electors equal in number to at least 5% of the total 
19votes cast for Governor in the preceding gubernatorial 
20election. The petition shall be signed by the petitioning 
21electors and filed with the State Board of Elections not more 
22than 90 days after the enactment of the Public Act. A petition 
23shall contain the Public Act number, the date of the general

1election at which the proposed amendment is to be submitted, 
2and the date, if the Public Act is rejected, that it will cease 
3to be in effect.
4    (b)   The procedure for determining the validity and 
5sufficiency of a petition shall be provided by law. If the 
6petition is valid and sufficient, the proposed referendum 
7shall be submitted to the electors at the general election 
8specified in the petition. If the voters in the specified 
9election reject the Public Act, it shall cease to be in effect 
10on the date specified in the referendum.

SCHEDULE

  
12    This Constitutional Amendment takes effect upon being 
13declared adopted in accordance with Section 7 of the Illinois 
14Constitutional Amendment Act.
