Provides that the corporate authorities of a municipality may use an existing utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged for the use of a utility pole shall be at the lowest rate charged by the entity owning the utility pole and shall not exceed the entity's actual costs. |

| 1 | | AN ACT concerning local government. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Illinois Municipal Code is amended by |
| 5 | | adding Section 11-80-25 as follows: |
| 6 | | (65 ILCS 5/11-80-25 new) |
| 7 | | Sec. 11-80-25. Municipal use of utility pole for public |
| 8 | | safety purposes. |
| 9 | | (a) The corporate authorities of a municipality may use an |
| 10 | | existing utility pole within its public rights-of-way for |
| 11 | | municipal public safety purposes, including, but not limited |
| 12 | | to, the placing of equipment associated with public safety. |
