| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The State Fair Act is amended by changing |
| 5 | | Section 12 as follows:
|

The Department shall have the power to |
| 8 | | promulgate rules and
regulations, pursuant to the Illinois |
| 9 | | Administrative Procedure Act, governing the holding of each |
| 10 | | State Fair, the operation of the
State Fairgrounds, the |
| 11 | | conditions under which racing shall be permitted on
the State |
| 12 | | Fairgrounds, the policy for policing the grounds and such |
| 13 | | other
reasonable rules and regulations as are necessary to |
| 14 | | carry out the intent of the Act. However, the Department shall |
| 15 | | not be required to promulgate rules and regulations pursuant |
| 16 | | to the Illinois Administrative Procedure Act concerning those |
| 17 | | operations stated in subsections (b) and (c) of Section 6 of |
| 18 | | this Act. Instead, the requirements set forth in subsections |
| 19 | | (b) and (c) of Section 6 must be followed.
