AMENDMENT TO SENATE BILL 763

2    AMENDMENT NO. ______. Amend Senate Bill 763 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Broadband Infrastructure Advancement Act 
5is amended by changing Section 4-20 as follows:
 
6    (220 ILCS 81/4-20)
7    Sec. 4-20. Use of other broadband funds. 
8    (a) The Department of Commerce and Economic Opportunity, 
9the Office of Broadband, or any other State agency, board, 
10office, or commission appropriated funding to provide grants 
11for broadband deployment, broadband expansion, broadband 
12access, broadband affordability, and broadband improvement 
13projects must establish program eligibility and selection 
14criteria by administrative rules.
15    (b) Except as otherwise required by federal law, any grant 
16to an electric cooperative for the purpose of a broadband

1deployment, broadband expansion, broadband access, broadband 
2affordability, or broadband improvement project that requires 
3the electric cooperative to amend or expand existing easement 
4rights shall not require the project to be completed earlier 
5than 5 years after the date the grant agreement is entered into 
6by the electric cooperative. As used in this subsection, 
7"electric cooperative" has the meaning given in Section 3-119 
8of the Public Utilities Act.

10    Section 99. Effective date. This Act takes effect upon
