| 11 | | Sec. 405-545. Opioid antagonists. |
| 12 | | (a) As used in this Section, "opioid antagonist" has the |
| 13 | | meaning given to that term in Section 5-23 of the Substance Use |
| 14 | | Disorder Act |
| 15 | | (b) A State agency may make opioid antagonists available |
| 16 | | at a location where its employees work if the State agency |
| 17 | | trains employees in the use and administration of the opioid |
| 18 | | antagonists. |
| 19 | | (c) An employee of a State agency that uses and |
| 20 | | administrates opioid antagonists as described in this Section |
| 21 | | is exempt from civil liability under Section 69 of the Good |
| 22 | | Samaritan Act. |
| 23 | | Section 10. The Good Samaritan Act is amended by adding |
| 24 | | Section 69 as follows: |

| 2 | | Sec. 69. Employees of State agencies; exemptions from |
| 3 | | civil liability for the administration of an opioid |
| 4 | | antagonist. Any employee of a State agency who in good faith |
| 5 | | administers an opioid antagonist, as defined in Section 5-23 |
| 6 | | of the Substance Use Disorder Act, in compliance with Section |
| 7 | | 405-545 of the Department of Central Management Services Law |
| 8 | | of the Civil Administrative Code of Illinois shall not, as a |
| 9 | | result of her or his acts or omissions, except for willful or |
| 10 | | wanton misconduct on the part of the employee in administering |
| 11 | | the drug, be liable for civil damages. |
| 12 | | Section 99. Effective date. This Act takes effect July 1, |
| 13 | | 2025.". |
