AMENDMENT TO HOUSE BILL 5014

2    AMENDMENT NO. ______. Amend House Bill 5014 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Procurement Code is amended by 
5adding Section 55-30 as follows:
 
6    (30 ILCS 500/55-30 new)
7    Sec. 55-30. Value-added resellers.
8    (a) If a public institution of higher education or a State 
9agency uses a value-added reseller for the purchase of any 
10information technology hardware under this Code, then that 
11public institution of higher education or State agency may 
12require the value-added reseller to include in its bid an 
13attestation from the manufacturer of the goods stating that 
14the manufacturer offers the goods for sale to all value-added 
15resellers at substantially the same terms that apply to the 
16bidder's purchase of the goods from the manufacturer,

1including price, discounts, commissions, rebates, and other 
2incentives that impact the consideration paid for the goods. 
3If the public institution of higher education or State agency 
4imposes such a requirement, then the specifications for the 
5bid must clearly include this requirement.
6    (b) Notwithstanding any other provision of law, the 
7Department of Innovation and Technology and the University of 
8Illinois must each include the requirements set forth in 
9subsection (a) when making at least one procurement of 
10information technology hardware during State fiscal year 2025. 
11    (c) Notwithstanding any other provision of law, the agency 
12or public institution of higher education may decline to award 
13the bid to the value-added reseller if the agency or public 
14institution of higher education determines that the price is 
15not competitive. 
16    (d) As used in this Section:
17    "Information technology hardware" means laptops, desktops, 
18tablets, monitors, docking stations, telephones, headsets, 
19cable cords, computers, servers, and wires. 
20    "Public institution of higher education" has the meaning 
21given to that term in Section 1-13. 
22    "Value-added reseller" means a company that resells 
23information technology hardware and provides value, such as 
24installation services, software, or service contracts, in 
25addition to the original order fulfillment.

1    Section 99. Effective date. This Act takes effect upon 
2becoming law.".
