| 2 | | AMENDMENT NO. ______. Amend House Bill 4442 on page 1, |
| 3 | | immediately below line 3, by inserting the following: |
| 4 | | "Section 3. The Property Tax Code is amended by changing |
| 5 | | Section 2-45 as follows: |
| 6 | | (35 ILCS 200/2-45) |
| 7 | | Sec. 2-45. Selection and eligibility of township and |
| 8 | | multi-township assessors. |
| 9 | | (a) In all counties under township organization, township |
| 10 | | or multi-township assessors shall be qualified as required by |
| 11 | | subsections (b) through (d) of this Section and shall be |
| 12 | | elected as provided in this Code. Township or multi-township |
| 13 | | assessors shall enter upon their duties on January 1 following |
| 14 | | their election, and perform the duties of the office for 4 |
| 15 | | years. |
| 16 | | (b) Beginning December 1, 1996, in any township or |

| 1 | | multi-township assessment district not subject to the |
| 2 | | requirements of subsections (c) or (d) of this Section, no |
| 3 | | person is eligible to file nomination papers or participate as |
| 4 | | a candidate in any caucus or primary or general election for, |
| 5 | | or be appointed to fill vacancies in, the office of township or |
| 6 | | multi-township assessor, unless he or she (i) has successfully |
| 7 | | completed an introductory course in assessment practices that |
| 8 | | is approved by the Department; or (ii) possesses at least one |
| 9 | | of the qualifications listed in paragraphs (1) through (6) of |
| 10 | | subsection (c) of this Section. The candidate cannot file |
| 11 | | nominating papers or participate as a candidate unless a copy |
| 12 | | of the certificate of his or her qualifications from the |
| 13 | | Department is filed with the township clerk, board of election |
| 14 | | commissioners, or other appropriate authority as required by |
| 15 | | the Election Code. The candidate cannot be appointed to fill a |
| 16 | | vacancy until he or she has filed a copy of the certificate of |
| 17 | | his or her qualifications from the Department with the |
| 18 | | appointing authority. |
| 19 | | (c) Beginning December 1, 1996, in a township or |
| 20 | | multi-township assessment district with $25,000,000 or more of |
| 21 | | non-farm equalized assessed value or $1,000,000 or more in |
| 22 | | commercial and industrial equalized assessed value, no person |
| 23 | | is eligible to file nomination papers or participate as a |
| 24 | | candidate in any caucus or primary or general election for, or |
| 25 | | be appointed to fill vacancies in, the office of township or |
| 26 | | multi-township assessor, unless he or she possesses at least |

| 1 | | one of the qualifications listed in paragraphs (1) through (6) |
| 2 | | of this subsection (c). |
| 3 | | (1) a currently active Certified Illinois Assessing |
| 4 | | Officer designation from the Illinois Property Assessment |
| 5 | | Institute; |
| 6 | | (2) (blank); |
| 7 | | (3) a currently active AAS, CAE, or MAS designation |
| 8 | | from the International Association of Assessing Officers; |
| 9 | | (4) a currently active MAI, SREA, SRPA, SRA, or RM |
| 10 | | designation from the Appraisal Institute; |
| 11 | | (5) a currently active professional designation by any |
| 12 | | other appraisal or assessing association approved by the |
| 13 | | Department; or |
| 14 | | (6) (blank). |
| 15 | | The candidate cannot file nominating papers or participate |
| 16 | | as a candidate unless a copy of the certificate of his or her |
| 17 | | qualifications from the Department is filed with the township |
| 18 | | clerk, board of election commissioners, or other appropriate |
| 19 | | authority as required by the Election Code. The candidate |
| 20 | | cannot be appointed to fill a vacancy until he or she has filed |
| 21 | | a copy of the certificate of his or her qualifications with the |
| 22 | | appointing authority. |
| 23 | | (d) Beginning December 1, 2000, in a township or |
| 24 | | multi-township assessment district with more than $10,000,000 |
| 25 | | and less than $25,000,000 of non-farm equalized assessed value |
| 26 | | and less than $1,000,000 in commercial and industrial |

| 1 | | equalized assessed value, no person who has previously been |
| 2 | | elected as township or multi-township assessor in any such |
| 3 | | township or multi-township assessment district is eligible to |
| 4 | | file nomination papers or participate as a candidate in any |
| 5 | | caucus or primary or general election for the office of |
| 6 | | township or multi-township assessor, unless he or she |
| 7 | | possesses at least one of the qualifications listed in |
| 8 | | paragraphs (1) through (6) of subsection (c) of this Section. |
| 9 | | The candidate cannot file nominating papers or participate as |
| 10 | | a candidate unless a copy of the certificate of his or her |
| 11 | | qualifications from the Department is filed with the township |
| 12 | | clerk, board of election commissioners, or other appropriate |
| 13 | | authority as required by the Election Code. |
| 14 | | (e) If any person files nominating papers for candidacy |
| 15 | | for the office of township or multi-township assessor without |
| 16 | | also filing a copy of the certificate of his or her |
| 17 | | qualifications from the Department as required by this |
| 18 | | Section, the clerk of the township, the board of election |
| 19 | | commissioners, or other appropriate authority as required by |
| 20 | | the Election Code shall refuse to certify the name of the |
| 21 | | person as a candidate to the proper election officials. |
| 22 | | If no candidate for election meets the above |
| 23 | | qualifications there shall be no election and the town board |
| 24 | | of trustees or multi-township board of trustees shall appoint |
| 25 | | or contract with a person under Section 2-60. |
| 26 | | (f) Notwithstanding any other provision of law, with |

| 1 | | respect to the office of township or multi-township assessor |
| 2 | | for any township or multi-township assessment district located |
| 3 | | in Lake County, for the 2025 consolidated election and the |
| 4 | | 2029 consolidated election, a person is eligible to file |
| 5 | | nomination papers or participate as a candidate for that |
| 6 | | office without having obtained the qualifications listed in |
| 7 | | paragraphs (1) through (6) of subsection (c) if the person has |
| 8 | | successfully completed an introductory course in assessment |
| 9 | | practices that is approved by the Department. If the person |
| 10 | | would otherwise be required to obtain one of the |
| 11 | | qualifications listed in paragraphs (1) through (6) of this |
| 12 | | subsection (c) to serve as township or multi-township |
| 13 | | assessor, that person shall obtain at least one of those |
| 14 | | qualifications prior to being sworn into office as township or |
| 15 | | multi-township assessor. The failure of such a person to |
| 16 | | obtain the necessary qualifications shall result in a vacancy |
| 17 | | in the office of township or multi-township assessor, which |
| 18 | | shall be filled as provided in Section 2-60. |
| 19 | | (g) As used in this Section only, "non-farm equalized |
| 20 | | assessed value" means the total equalized assessed value in |
| 21 | | the township or multi-township assessment district as reported |
| 22 | | to the Department under Section 18-225 after removal of |
| 23 | | homestead exemptions, and after removal of the equalized |
| 24 | | assessed value reported as farm or minerals to the Department |
| 25 | | under Section 18-225. |
