AMENDMENT TO HOUSE BILL 3907

AMENDMENT NO. ______. Amend House Bill 3907 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Section 24-9.5 as follows:

(105 ILCS 5/24-9.5 new)

Sec. 24-9.5. Teacher or clinician planning time.

(a) In this Section:

"Clinician" means a related service provider, including, but not limited to, a school social worker, school psychologist, school counselor, school nurse, school speech-language pathologist, or school physical or occupational therapist.

"Duty-free" means the time during which a teacher or clinician is not required to supervise students, collaborate with other school district employees, or attend meetings, trainings, or conferences of any kind.

(b) For every teacher or clinician of a school district who is in contact with students at least 50% of the teacher's or clinician's contracted work day, on and after the effective date of this amendatory Act of the 103rd General Assembly, a school district may not reduce any designated, duty-free planning time that is provided to teachers or clinicians by the school district, as agreed upon by the exclusive bargaining representative of the teachers or clinicians and the school district. Any agreements made on or after the effective date of this amendatory Act of the 103rd General Assembly between the exclusive bargaining representative of the teachers or clinicians and the school district may not reduce designated, duty-free planning time.

(c) If a teacher or clinician chooses to relinquish the teacher's or clinician's entitlement to designated, duty-free planning time under subsection (b), then the teacher or clinician shall be compensated for that relinquishment at a collectively bargained rate of pay.".
