| 1 | AN ACT concerning regulation.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Task | |||||||||||||||||||
| 5 | Force on Prescribing Psychologist Licensing and Oversight Act. | |||||||||||||||||||
| 6 | Section 5. Purpose.
The Task Force on Prescribing | |||||||||||||||||||
| 7 | Psychologist Licensing and Oversight is created within the | |||||||||||||||||||
| 8 | Department of Financial and Professional Regulation.
The Task | |||||||||||||||||||
| 9 | Force shall aim to answer the following questions:
| |||||||||||||||||||
| 10 | (1) How much can prescribing psychologists increase | |||||||||||||||||||
| 11 | overall access to care in this State?
| |||||||||||||||||||
| 12 | (2) Do prescribing psychologists receive the | |||||||||||||||||||
| 13 | appropriate training and oversight to protect patient | |||||||||||||||||||
| 14 | safety? | |||||||||||||||||||
| 15 | Section 10. Membership; appointment; vacancy; meeting | |||||||||||||||||||
| 16 | support.
| |||||||||||||||||||
| 17 | (a) The Task Force shall have the following members:
| |||||||||||||||||||
| 18 | (1) the Secretary of Financial and Professional | |||||||||||||||||||
| 19 | Regulation, or the Secretary's designee;
| |||||||||||||||||||
| 20 | (2) the Director of the Division of Professional | |||||||||||||||||||
| 21 | Regulation, or the Director's designee;
| |||||||||||||||||||
| 22 | (3) the Chief Medical Coordinator of the Division of | |||||||||||||||||||
| |||||||
| |||||||
| 1 | Professional Regulation;
| ||||||
| 2 | (4) the Speaker of the House of Representatives, or | ||||||
| 3 | the Speaker's designee;
| ||||||
| 4 | (5) the Minority Leader of the House of | ||||||
| 5 | Representatives, or the Leader's designee;
| ||||||
| 6 | (6) the President of the Senate, or the President's | ||||||
| 7 | designee;
| ||||||
| 8 | (7) the Minority Leader of the Senate, or the Leader's | ||||||
| 9 | designee;
| ||||||
| 10 | (8) a representative of a statewide membership | ||||||
| 11 | organization for psychiatrists in this State that serves | ||||||
| 12 | to provide education, professional collaboration, and | ||||||
| 13 | advocacy for its members, appointed by the Secretary;
| ||||||
| 14 | (9) a psychiatrist licensed and practicing in this | ||||||
| 15 | State who has received specific training to specialize in | ||||||
| 16 | treating child and adolescents patients, appointed by the | ||||||
| 17 | Secretary of Financial and Professional Regulation;
| ||||||
| 18 | (10) a psychiatrist licensed and practicing in this | ||||||
| 19 | State who has received specific training to specialize in | ||||||
| 20 | treating geriatric patients, appointed by the Secretary of | ||||||
| 21 | Financial and Professional Regulation;
| ||||||
| 22 | (11) a representative of a statewide membership | ||||||
| 23 | organization for this State prescribing psychologists that | ||||||
| 24 | serves to provide education, professional collaboration, | ||||||
| 25 | and advocacy for its members, appointed by the Secretary | ||||||
| 26 | of Financial and Professional Regulation;
| ||||||

| 1 | (12) a psychologist licensed and practicing in this | ||||||
| 2 | State who has received specific training to specialize in | ||||||
| 3 | treating child and adolescents patients, appointed by the | ||||||
| 4 | Secretary of Financial and Professional Regulation;
and | ||||||
| 5 | (13) a psychologist licensed and practicing in this | ||||||
| 6 | State who has received specific training to specialize in | ||||||
| 7 | treating geriatric patients, appointed by the Secretary of | ||||||
| 8 | Financial and Professional Regulation.
| ||||||
| 9 | (b) If a vacancy occurs in the Task Force, the vacancy | ||||||
| 10 | shall be filled in the same manner as the original appointment | ||||||
| 11 | for the remainder of the unexpired term.
| ||||||
| 12 | (c) The Task Force shall meet once every 2 months, | ||||||
| 13 | indefinitely, until the Task Force votes to dissolve itself. | ||||||
| 14 | Nothing in this Section prohibits the Task Force from meeting | ||||||
| 15 | more often if it deems it necessary to do so.
| ||||||
| 16 | (d) The Department shall provide administrative support to | ||||||
| 17 | the Task Force.
| ||||||
| 18 | (e) The Task Force shall only meet once a majority of | ||||||
| 19 | members are appointed.
| ||||||
| 20 | (f) The Secretary of Financial and Professional | ||||||
| 21 | Regulation, or the Secretary's designee, shall be the chair of | ||||||
| 22 | the Task Force.
| ||||||
| 23 | Section 15. Subject matter of the Task Force. The subject | ||||||
| 24 | matter of the Task Force shall include, but not be limited to, | ||||||
| 25 | the following inquiries:
| ||||||

| |||||||
| 1 | (a) Will allowing prescribing psychologists to expand the | ||||||
| 2 | prescribing psychologists' scope to include children and | ||||||
| 3 | seniors help increase access to treatment for underserved | ||||||
| 4 | areas and populations, including rural patients and patients | ||||||
| 5 | on Medicaid?
| ||||||
| 6 | (b) Do prescribing psychologists receive sufficient | ||||||
| 7 | regulatory oversight, medical supervision, and disciplinary | ||||||
| 8 | enforcement to fully protect patient safety?
| ||||||
| 9 | Section 20. Report.
| ||||||
| 10 | (a) The Task Force shall prepare an annual report that | ||||||
| 11 | summarizes its work and makes recommendations resulting from | ||||||
| 12 | its deliberations.
| ||||||
| 13 | (b) The Task Force shall submit the report of its findings | ||||||
| 14 | and recommendations to the Governor and the General Assembly.
| ||||||
| 15 | (c) The Task Force shall submit the first report no later | ||||||
| 16 | than one year after the first meeting of the Task Force.
