SYNOPSIS AS INTRODUCED:

Creates the Suicide Prevention Signage Act. Provides that a building, bridge, ferry, or park constructed or replaced after July 1, 2025 as a public works project must have in appropriate locations signs displaying the 9-8-8 national suicide prevention and mental health crisis hotline. Amends the Department of Veterans' Affairs Act. Requires the Department of Veterans' Affairs to administer a suicide prevention community-based services grant program to provide suicide prevention, peer support, and other assistance to at-risk and transitioning veterans and military members and their families. Requires the Department, in consultation with the Department of Public Health, to establish a process to receive, review, process, and award grants to organizations that address veterans, military members, and their families who may be at risk of suicide and other mental health crises. Creates the Veterans and Military Members Suicide Prevention Fund and sets forth the purpose of the Fund. Contains provisions on the creation of a database of information on State, federal, and community resources that address the mental health, well-being, and suicide prevention of veterans, military members, and their families; internet-accessible suicide education training and information for veterans, military members, and their families; a Suicide-Safer Homes Task Force; a State Global War on Terror Memorial; and other matters. Amends the Illinois Public Aid Code. Requires the Department of Human Services to inquire about the military service of all public aid applicants at the point of application. Amends the Firearm Dealer License Certification Act. Provides that an expansion of safe storage of firearms and reduced access to lethal means in the community is encouraged to better prevent suicide by veterans, military members, and their families. Provides that a licensed firearms dealer who allows a person to temporarily store a firearm on the dealer's premises in a storage locker, box, or container does not thereby create a special relationship, for civil liability purposes. Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue Prevent Veteran Suicide universal special license plates. Effective July 1, 2023, with some parts taking effect on October 1, 2023 and some parts taking effect July 1, 2025.

A BILL FOR

AN ACT concerning veterans.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Suicide Prevention Signage Act.

Section 5. Definitions. As used in this Act:

"Public body" means a State officer or agency or a unit of local government.

"Public works" means any fixed work construction or improvement undertaken by a public body if that fixed work construction or improvement is funded or financed in whole or in part with State funds or funds administered by the State.

Section 10. Suicide prevention signage. For any building, bridge, ferry, or park constructed or replaced after July 1, 2025, as a public works project, there must be installed in appropriate locations signs displaying the 9-8-8 national suicide prevention and mental health crisis hotline.

Section 15. Facilities recommended to have suicide prevention signage.

(a) The public body in control of a public works project must decide where signs would be physically feasible and appropriate. The following facilities are recommended to have such signs:

(1) Bridges where suicides by jumping have occurred or are likely to occur.

(2) Locations that provide services to people that have high incidence of suicide or mental health conditions that would benefit from knowing about the hotline.

(b) The signs must be designed to communicate that dialing 9-8-8 on a telephone will connect callers to behavioral health and suicide prevention services as provided in accordance with State and federal laws governing the 9-8-8 number.

(c) If a sign is located along a State highway or the interstate system, the Department of Transportation must approve the location prior to erecting the sign, but no permit is necessary.

Section 20. Conflict of laws. Signs created under this Act may not conflict with provisions of the federal Manual of Uniform Traffic Control Devices or existing State laws related to placement and design of signs.

Section 25. No private right of action. Nothing contained in this Act shall be construed as conferring a right of action in cases where no right of action exists independent of this Act. This Act is not intended to create a private right of action by any party or be used to impose liability on the public body if a sign has or has not been posted on the premises of the public facility or in any particular location recommended in this Act.

Section 30. Maintenance of signs. A public body may accept gifts or donations to pay for the creation, installation, or maintenance of signs under this Act.

Section 35. The Department of Professional Regulation Law is amended by adding Section 2105-370 as follows:

Sec. 2105-370. Educational materials on veterans and military members suicide prevention.

(a) Subject to appropriation, the Department shall consult with the Department of Veterans Affairs' to create educational materials informing health care providers regulated by the Department's Division of Professional Regulation about the availability of the nationwide 9-8-8 phone number for individuals in crisis to connect with suicide prevention and mental health crisis counselors. The educational materials must include information about the nationwide veterans crisis line for veterans and service members, and, beginning July 1, 2024, information about the resources developed under subsection (e) of Section 2i of the Department of Veterans' Affairs Act.

(b) The Department shall:

(1) determine the health professions to which this Section shall apply; and

(2) collaborate with the corresponding disciplinary authority or board to ensure that the educational materials are distributed electronically to appropriate licensed health care providers when a provider renews his or her license.

(c) Beginning July 1, 2024, all health care providers are strongly encouraged to inquire with new patients entering care whether the patient is a veteran, member of the military, or a family member of a veteran or member of the military. If the patient responds in the affirmative, the provider is encouraged to share the educational materials created under this Section with the patient.

Section 40. The Department of Veterans' Affairs Act is amended by adding Sections 2i, 2j, and 40 as follows:

Sec. 2i. Suicide prevention community-based services grant program.

(a) Legislative intent and findings.

(1) Suicide is a public health issue that affects many Illinois families and communities daily.

(2) Service members, veterans, and their families are at a higher risk of being affected by suicide as experiences prior to enlistment, during service, and transition from service can contribute to suicidal thoughts and behaviors.

(3) Family members of veterans who die by suicide are at higher risk for future suicide due to the exposure of experiencing suicide loss. Research shows for every suicide that occurs, 135 people suffer from the effects either directly or indirectly, meaning veteran suicides impact a community of 2,600,000 people.

(4) There is no one path to suicide, but life experiences, moral injury, trauma, culture, and health can play a major role in suicidal behavior. Military and veteran culture in particular includes stigma around mental wellness and help-seeking behavior, emphasizes reliability on group cohesion, and facilitates access, comfortability, and familiarity with lethal means such as firearms. Additionally, a significant number of veterans do not seek care within the veterans administration system.

(7) The General Assembly intends to address the tragedy of suicide among veterans, military members, and their families through support of professionals and community and peer organizations serving veterans, cultural changes that support help-seeking behaviors, and investments in education, training, prevention, and care.

(b) As used in this Section:

"Fund" means the Veterans and Military Members Suicide Prevention Fund.

"Military members" means Illinois residents who are actively serving members of the Illinois National Guard or United States Reserve Forces, or active duty military personnel.

"Veteran" means an Illinois resident who has served as a member of the United States Armed Services on active duty, a member of the Illinois National Guard, or a member of the United States Reserve Forces, and who has received an honorable discharge.

(c) Suicide prevention community-based services grant program.

(1) The Department shall establish and administer a suicide prevention community-based services grant program for the purpose of providing suicide prevention, peer support, and other assistance to at-risk and transitioning veterans and military members and their families in their communities.

(2) Subject to appropriation and any amounts disbursed from the Veterans and Military Members Suicide Prevention Fund created in subsection (d), the Department, in consultation with the Department of Public Health's suicide prevention coordinator project manager, must establish a process to receive, review, process, and award grants to organizations, including nonprofit and peer support community programs, that address veterans, military members, and their families who may be at risk of suicide and other mental health crises. Priority must be given to organizations using peer support models that use evidence-based, research-based, or promising practices.

(3) The Department shall report to the General Assembly annually beginning July 1, 2024, on grant recipients, the number of veterans and military members served, and the types of services offered by grant recipients.

(4) The Department of Public Health and its suicide prevention coordinator project manager shall evaluate the effectiveness of each grant program recipient providing suicide prevention and peer support services to veterans, military members, and their families who may be at risk of suicide and other mental health crises.

(d) Veterans and Military Members Suicide Prevention Fund.

(1) The Veterans and Military Members Suicide Prevention Fund is created as a special find in the State treasury. The Fund shall consist of moneys appropriated by the General Assembly, revenues received from the Prevent Veteran Suicide universal special license plates, and all receipts from gifts, grants, bequests, devises, or other donations from public and private sources to support veterans and military members suicide prevention measures. Expenditures from the Fund may be used only for the purposes provided in paragraph (3) of this subsection. Only the Director of Veterans' Affairs or the Director's designee may authorize expenditures from the Fund.

(2)(A) The Department may request and accept nondedicated contributions, grants, or gifts in cash or otherwise, and voluntary donations for deposit into the Fund, including funds generated by voluntary donations under subparagraph (B).

(B) The Department may accept, for deposit into the account, voluntary donations from persons who are:

(i) applying for a concealed pistol license or renewal of a concealed pistol license; or

(ii) undergoing a background check under Section 3.1 of the Firearm Owners Identification Card Act in connection with the purchase of a firearm from a firearms dealer.

The Department shall coordinate with local law enforcement agencies, the Illinois State Police, and firearms dealers licensed under the Firearm Dealer License Certification Act to develop a form and process for publicizing and collecting voluntary donations under this subparagraph. The Department and the Illinois State Police shall post educational information regarding the voluntary donation provisions of this subsection on their websites.

(3) All moneys deposited into the Fund must be used for activities that are dedicated to the benefit of veteran and military member suicide education and prevention including, but not limited to, providing programs, peer support, and services that assist veterans and military members in addressing mental health and wellness impacts of military service, trauma, moral injury, and transition to civilian life. Moneys may also be used for the suicide prevention community-based services grant program established in subsection (c). Moneys from the Fund may not be used to supplant existing moneys received by the Department nor shall grant recipients use the moneys to supplant existing funding.

(e) Subject to the availability of amounts appropriated for this specific purpose, the Department shall:

(1) Create and maintain a database of information on nonprofit, for-profit, city, county, State, and federal organizations, providers, and resources that address the mental health, well-being, and suicide prevention of veterans, military members, and their families. The Department shall establish criteria for inclusion in the database by July 1, 2023. The Department must make the database accessible on its website to veterans, military members, and their families by July 1, 2024.

(2) Provide suicide prevention education training and information for veterans, military members, and their families that is accessible through the internet.

(3) By December 1, 2024, create, in consultation with the Suicide-Safer Homes Task Force established under Section 2j of this Act, a web-based application to be shared by State agencies and primary care providers with veterans, military members, and their families to provide applicable information and resources, including, but not limited to, benefits, mental health resources, and lethal means safety information.

Sec. 2j. Suicide-Safer Homes Task Force.

(a) Subject to appropriation, a Suicide-Safer Homes Task Force is established to raise public awareness and increase suicide prevention education among new partners who are in key positions to help reduce suicide. The Task Force shall be administered and staffed by the Department. To the extent possible, the Task Force membership shall include representatives from geographically diverse and priority populations.

(b) The Suicide-Safer Homes Task Force shall be co-chaired by the Director of Veterans' Affairs, or the Director's designee, and the Department of Public Health's suicide prevention coordinator project manager, or the suicide prevention coordinator project manager's designee, and shall also consist of the following members:

(1) Two representatives of suicide prevention organizations, selected by the co-chairs of the Task Force.

(2) Two representatives of the firearms industry, selected by the co-chairs of the Task Force.

(3) Two individuals who are suicide attempt survivors or who have experienced suicide loss, selected by the co-chairs of the Task Force.

(4) Two representatives of law enforcement agencies, selected by the co-chairs of the Task Force.

(5) One representative from the Department of Public Health.

(6) One representative from the Department of Natural Resources.

(7) One individual representing veterans.

(8) Two veterans.

(9) One representative of the National Rifle Association.

(10) One representative of the Second Amendment Foundation.

(11) One representative of a nonprofit organization working on gun safety issues.

(12) One representative of a national firearms trade association.

(13) One representative of a State pharmacy association.

(14) No more than 5 other interested parties, selected by the co-chairs of the Task Force.

(c) The Department of Veterans' Affairs shall convene the initial meeting of the Task Force.

(d) The Task Force shall:

(1) develop and prepare to disseminate online trainings on suicide awareness and prevention for firearms dealers and their employees and firearm range owners and their employees;

(2) partner with medical providers, firearms dealers, firearms ranges, and pharmacies to develop and distribute suicide awareness and prevention messages for posters and brochures;

(3) in consultation with the Department of Natural Resources, develop strategies for creating and disseminating suicide awareness and prevention information for hunting safety classes, including messages to parents that can be shared during online registration, in either follow-up email communications, or in writing, or both;

(4) create a website that will be a clearinghouse for the newly created suicide awareness and prevention materials developed by the Task Force;

(5) continue to support medical providers with suicide prevention and awareness work through the dissemination of collateral education programs;

(6) allocate funding towards the purchase of firearm lock boxes for dissemination to veterans and military members and their families as prescribed by the Department of Veterans' Affairs by rule;

(7) develop and direct advocacy efforts with firearms dealers to pair suicide awareness and prevention training with distribution of safe storage devices;

(8) partner with a statewide pharmacy association to market and promote medication disposal kits and safe storage devices;

(9) train health care providers on suicide awareness and prevention, paired with distribution of medication disposal kits and safe storage devices; and

(10) train local law enforcement officers on suicide awareness and prevention, paired with distribution of medication disposal kits and safe storage devices.

(e) The Department of Public Health and its suicide prevention coordinator project manager shall provide subject matter expertise, technical and programmatic support, and consultation and evaluation to the Task Force.

(f) Beginning December 1, 2023, the Task Force shall annually report to the General Assembly on the status of its work.

(g) This Section is repealed on July 1, 2025.

Sec. 40. State Global War on Terror Memorial.

(a) Any memorial established on any land held by the Department of Veterans' Affairs to commemorate the global war on terror must recognize service members who died in Operation Iraqi Freedom, Operation Enduring Freedom, and Operation New Dawn, which are classified under the umbrella term global war on terror. Any such memorial must include a component designed to reflect on the great number of active duty service members and veterans who have died by suicide after serving in these wars. The design of such a memorial must serve to honor those who are lost and provide a sacred space for healing and reflection for veterans and military families.

(b) The State Global War on Terror Memorial Fund is created as a special fund in the State treasury. The purpose of the Fund is to support the establishment and maintenance of the Global War on Terror Memorial. The Director of Veterans' Affairs may solicit and accept moneys from gifts, grants, or endowments for this purpose. All receipts from federal funds, gifts, or grants from the private sector, foundations, or other sources must be deposited into the Fund. Expenditures from the Fund may be used only for the design, siting, permitting, construction, maintenance, dedication, or creation of educational materials related to placement of this memorial on land held by the Department of Veterans' Affairs. Only the Director, or the Director's designee, may authorize expenditures from the Fund. The Director may adopt rules governing the receipt and use of moneys in the Fund.

Section 45. The State Finance Act is amended by adding Section 5.990 as follows:

Section 55. The Illinois Public Aid Code is amended by adding Section 1-13 as follows:

Sec. 1-13. Military status. During the application process for public assistance benefits, the Department shall inquire of each applicant whether the applicant has ever served in the United States military services or is a family or household member of someone who has ever served in the United States military services. If the applicant answers in the affirmative, the Department shall provide the applicant with information on how to contact the Department of Veterans' Affairs to inquire as to whether the applicant may be eligible for any benefits, services, or programs offered to veterans, military members, or their families.

Section 60. The Firearm Dealer License Certification Act is amended by adding Section 5-57 as follows:

Sec. 5-57. Storage services.

(a) In order to better prevent suicide by veterans, military members, and their families, an expansion of safe storage of firearms and reduced access to lethal means in the community is encouraged.

(b) A certified licensee who provides a service of allowing a person to temporarily store a firearm on the certified licensee's premises in a storage locker, box, or container that is locked and not accessible to the certified licensee does not thereby create a special relationship, for civil liability purposes, between the certified licensee and the person who temporarily stores the firearm on the certified licensee's premises.

Section 65. The Illinois Vehicle Code is amended by changing Section 3-699.14 as follows:

Sec. 3-699.14. Universal special license plates.

(a) In addition to any other special license plate, the Secretary, upon receipt of all applicable fees and applications made in the form prescribed by the Secretary, may issue Universal special license plates to residents of Illinois on behalf of organizations that have been authorized by the General Assembly to issue decals for Universal special license plates. Appropriate documentation, as determined by the Secretary, shall accompany each application. Authorized organizations shall be designated by amendment to this Section. When applying for a Universal special license plate the applicant shall inform the Secretary of the name of the authorized organization from which the applicant will obtain a decal to place on the plate. The Secretary shall make a record of that organization and that organization shall remain affiliated with that plate until the plate is surrendered, revoked, or otherwise cancelled. The authorized organization may charge a fee to offset the cost of producing and distributing the decal, but that fee shall be retained by the authorized organization and shall be separate and distinct from any registration fees charged by the Secretary. No decal, sticker, or other material may be affixed to a Universal special license plate other than a decal authorized by the General Assembly in this Section or a registration renewal sticker. The special plates issued under this Section shall be affixed only to passenger vehicles of the first division, including motorcycles and autocycles, or motor vehicles of the second division weighing not more than 8,000 pounds. Plates issued under this Section shall expire according to the multi-year procedure under Section 3-414.1 of this Code.

(b) The design, color, and format of the Universal special license plate shall be wholly within the discretion of the Secretary. Universal special license plates are not required to designate "Land of Lincoln", as prescribed in subsection (b) of Section 3-412 of this Code. The design shall allow for the application of a decal to the plate. Organizations authorized by the General Assembly to issue decals for Universal special license plates shall comply with rules adopted by the Secretary governing the requirements for and approval of Universal special license plate decals. The Secretary may, in his or her discretion, allow Universal special license plates to be issued as vanity or personalized plates in accordance with Section 3-405.1 of this Code. The Secretary of State must make a version of the special registration plates authorized under this Section in a form appropriate for motorcycles and autocycles.

(c) When authorizing a Universal special license plate, the General Assembly shall set forth whether an additional fee is to be charged for the plate and, if a fee is to be charged, the amount of the fee and how the fee is to be distributed. When necessary, the authorizing language shall create a special fund in the State treasury into which fees may be deposited for an authorized Universal special license plate. Additional fees may only be charged if the fee is to be paid over to a State agency or to a charitable entity that is in compliance with the registration and reporting requirements of the Charitable Trust Act and the Solicitation for Charity Act. Any charitable entity receiving fees for the sale of Universal special license plates shall annually provide the Secretary of State a letter of compliance issued by the Attorney General verifying that the entity is in compliance with the Charitable Trust Act and the Solicitation for Charity Act.

(d) Upon original issuance and for each registration renewal period, in addition to the appropriate registration fee, if applicable, the Secretary shall collect any additional fees, if required, for issuance of Universal special license plates. The fees shall be collected on behalf of the organization designated by the applicant when applying for the plate. All fees collected shall be transferred to the State agency on whose behalf the fees were collected, or paid into the special fund designated in the law authorizing the organization to issue decals for Universal special license plates. All money in the designated fund shall be distributed by the Secretary subject to appropriation by the General Assembly.

(e) The following organizations may issue decals for Universal special license plates with the original and renewal fees and fee distribution as follows:

(1) The Illinois Department of Natural Resources.

(A) Original issuance: $25; with $10 to the Roadside Monarch Habitat Fund and $15 to the Secretary of State Special License Plate Fund.

(B) Renewal: $25; with $23 to the Roadside Monarch Habitat Fund and $2 to the Secretary of State Special License Plate Fund.

(2) Illinois Veterans' Homes.

(A) Original issuance: $26, which shall be deposited into the Illinois Veterans' Homes Fund.

(B) Renewal: $26, which shall be deposited into the Illinois Veterans' Homes Fund.

(3) The Illinois Department of Human Services for volunteerism decals.

(A) Original issuance: $25, which shall be deposited into the Secretary of State Special License Plate Fund.

(B) Renewal: $25, which shall be deposited into the Secretary of State Special License Plate Fund.

(4) The Illinois Department of Public Health.

(A) Original issuance: $25; with $10 to the Prostate Cancer Awareness Fund and $15 to the Secretary of State Special License Plate Fund.

(B) Renewal: $25; with $23 to the Prostate Cancer Awareness Fund and $2 to the Secretary of State Special License Plate Fund.

(5) Horsemen's Council of Illinois.

(A) Original issuance: $25; with $10 to the Horsemen's Council of Illinois Fund and $15 to the Secretary of State Special License Plate Fund.

(B) Renewal: $25; with $23 to the Horsemen's Council of Illinois Fund and $2 to the Secretary of State Special License Plate Fund.

(B) Renewal: $25; with $23 to the Future Farmers of America Fund and $2 to the Secretary of State Special License Plate Fund.

(17) The Department of Veterans' Affairs for Prevent Veteran Suicide decals.

(A) Original issuance: $25; with $10 to the Veterans and Military Members Suicide Prevention Fund created in subsection (d) of Section 2i of the Department of Veterans' Affairs Act, and $15 to the Secretary of State Special License Plate Fund.

(B) Renewal: $25; with $23 to the Veterans and Military Members Suicide Prevention Fund and $2 to the Secretary of State Special License Plate Fund.

(f) The following funds are created as special funds in the State treasury:

(1) The Roadside Monarch Habitat Fund. All money in the Roadside Monarch Habitat Fund shall be paid as grants to the Illinois Department of Natural Resources to fund roadside monarch and other pollinator habitat development, enhancement, and restoration projects in this State.

(2) The Prostate Cancer Awareness Fund. All money in the Prostate Cancer Awareness Fund shall be paid as grants to the Prostate Cancer Foundation of Chicago.

(3) The Horsemen's Council of Illinois Fund. All money in the Horsemen's Council of Illinois Fund shall be paid as grants to the Horsemen's Council of Illinois.

(4) The Post-Traumatic Stress Disorder Awareness Fund. All money in the Post-Traumatic Stress Disorder Awareness Fund shall be paid as grants to K9s for Veterans, NFP for support, education, and awareness of veterans with post-traumatic stress disorder.

(5) The Guide Dogs of America Fund. All money in the Guide Dogs of America Fund shall be paid as grants to the International Guiding Eyes, Inc., doing business as Guide Dogs of America.

(6) The Mechanics Training Fund. All money in the Mechanics Training Fund shall be paid as grants to the Mechanics Local 701 Training Fund.

(7) The Theresa Tracy Trot - Illinois CancerCare Foundation Fund. All money in the Theresa Tracy Trot - Illinois CancerCare Foundation Fund shall be paid to the Illinois CancerCare Foundation for the purpose of furthering pancreatic cancer research.

(8) The Developmental Disabilities Awareness Fund. All money in the Developmental Disabilities Awareness Fund shall be paid as grants to the Illinois Department of Human Services to fund legal aid groups to assist with guardianship fees for private citizens willing to become guardians for individuals with developmental disabilities but who are unable to pay the legal fees associated with becoming a guardian.

(9) The Pediatric Cancer Awareness Fund. All money in the Pediatric Cancer Awareness Fund shall be paid as grants to the Cancer Center at Illinois for pediatric cancer treatment and research.

(10) The Folds of Honor Foundation Fund. All money in the Folds of Honor Foundation Fund shall be paid as grants to the Folds of Honor Foundation to aid in providing educational scholarships to military families.

(11) The Experimental Aircraft Association Fund. All money in the Experimental Aircraft Association Fund shall be paid, subject to appropriation by the General Assembly and distribution by the Secretary, as grants to promote recreational aviation.

(12) The Child Abuse Council of the Quad Cities Fund. All money in the Child Abuse Council of the Quad Cities Fund shall be paid as grants to benefit the Child Abuse Council of the Quad Cities.

(13) The Illinois Health Care Workers Benefit Fund. All money in the Illinois Health Care Workers Benefit Fund shall be paid as grants to the Trinity Health Foundation for the benefit of health care workers, doctors, nurses, and others who work in the health care industry in this State.

(14) The Future Farmers of America Fund. All money in the Future Farmers of America Fund shall be paid as grants to the Illinois Association of Future Farmers of America.

Section 99. Effective date. This Act takes effect July 1, 2023, except that Section 65 takes effect October 1, 2023 and Sections 1 through 30 take effect July 1, 2025.
