| 2 | | AMENDMENT NO. ______. Amend House Bill 2789 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Illinois Library System Act is amended by |
| 5 | | changing Sections 1 and 3 and by adding Section 8.7 as follows:
|
| 6 | | (75 ILCS 10/1) (from Ch. 81, par. 111)

| 7 | | Sec. 1.
Because the state has a financial responsibility
|
| 8 | | in promoting public
education, and because the public library |
| 9 | | is a vital agency serving all
levels of the educational |
| 10 | | process, it is hereby declared to be the policy
of the state to |
| 11 | | encourage the improvement of free public libraries and
to |
| 12 | | encourage cooperation among all types of libraries in |
| 13 | | promoting the sharing
of library resources, including digital |
| 14 | | resources. In keeping with this policy, provision is hereby
|
| 15 | | made for a program of state grants designed to establish, |
| 16 | | develop and
operate a network of library systems covering the |
|

|
|
| 1 | | entire state.
|
| 2 | | It is further declared to be the policy of the State to |
| 3 | | encourage and protect the freedom of libraries and library |
| 4 | | systems to acquire materials without external limitation and |
| 5 | | to be protected against attempts to ban, remove, or otherwise |
| 6 | | restrict access to books or other materials. |

| 9 | | Sec. 3.
The State Librarian and the Illinois State Library |
| 10 | | his staff shall administer the provisions
of this Act and |
| 11 | | shall prescribe such rules and regulations as are necessary
to |
| 12 | | carry the provisions of this Act into effect.
|
| 13 | | The rules and regulations established by the State |
| 14 | | Librarian for the
administration of this Act shall be designed |
| 15 | | to achieve the following
standards and objectives:
|
| 16 | | A provide library service for every citizen in the state |
| 17 | | by extending
library facilities to areas not now served.
|
| 18 | | B provide library materials for student needs at every |
| 19 | | educational
level.
|
| 20 | | C provide adequate library materials to satisfy the |
| 21 | | reference and
research needs of the people of this state.
|
| 22 | | D provide an adequate staff of professionally trained |
| 23 | | librarians for
the state.
|
| 24 | | E adopt the American Library Association's Library Bill of |
| 25 | | Rights that indicates materials should not be proscribed or |
|

| 1 | | removed because of partisan or doctrinal disapproval or, in |
| 2 | | the alternative, develop a written statement declaring the |
| 3 | | inherent authority of the library or library system to provide |
| 4 | | an adequate collection stock of books and other materials |
| 5 | | sufficient in
size and varied in kind and subject matter to |
| 6 | | satisfy the library needs of
the people of this state and |
| 7 | | prohibit the practice of banning specific books or resources.
|
| 8 | | F provide adequate library outlets and facilities |
| 9 | | convenient in time
and place to serve the people of this state.
|
| 10 | | G encourage existing and new libraries to develop library |
| 11 | | systems
serving a sufficiently large population to support |
| 12 | | adequate library service
at reasonable cost.
|
| 13 | | H foster the economic and efficient utilization of public |
| 14 | | funds.
|
| 15 | | I promote the full utilization of local pride, |
| 16 | | responsibility,
initiative and support of library service and |
| 17 | | at the same time employ state
aid as a supplement to local |
| 18 | | support.
|
| 19 | | The Advisory Committee of the Illinois State Library shall |
| 20 | | confer with,
advise and make recommendations to the State |
| 21 | | Librarian regarding any matter
under this Act and particularly |
| 22 | | with reference to the formation of library
systems.

| 2 | | adopt the American Library Association's Library Bill of |
| 3 | | Rights that indicates materials should not be proscribed or |
| 4 | | removed because of partisan or doctrinal disapproval or, in |
| 5 | | the alternative, develop a written statement prohibiting the |
| 6 | | practice of banning books or other materials within the |
| 7 | | library or library system.".
