| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by changing Section |
| 5 | | 29-6.1 as follows:
|
| 6 | | (105 ILCS 5/29-6.1) (from Ch. 122, par. 29-6.1)

| 7 | | Sec. 29-6.1. Contracts for transportation. Subject to |
| 8 | | Section 6-106.11
of the Illinois Vehicle Code,
school boards |
| 9 | | may enter into contracts for any period of time deemed |
| 10 | | appropriate by those school boards up to 3 years for |
| 11 | | transportation
of pupils to and from school; however, no |
| 12 | | contract, inclusive of any proposed renewals, may exceed 10 |
| 13 | | years. All contracts for a period of time greater than 5 years |
| 14 | | that do not include the use of electric vehicles for pupil |
| 15 | | transportation shall include a termination option after 5 |
| 16 | | years. Nothing in this Section prohibits contract opener |
| 17 | | clauses for any purpose from being included in the contract. A |
| 18 | | contract for pupil transportation that utilizes a significant |
| 19 | | percentage of electric vehicles may be entered into by a |
| 20 | | school board for up to 15 years if the contract relies on |
| 21 | | capital or infrastructure purchases or improvements that |
| 22 | | cannot reasonably be justified in a shorter-term contract. |
