| 1 | | AN ACT concerning health.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Overdose Prevention and Harm Reduction Act |
| 5 | | is amended by changing Section 10 as follows: |
| 6 | | (410 ILCS 710/10) |
| 7 | | Sec. 10. Dispensing of drug adulterant testing supplies. A |
| 8 | | pharmacist, physician, advanced practice registered nurse, or |
| 9 | | physician assistant, or the pharmacist's, physician's, |
| 10 | | advanced practice registered nurse's, or physician assistant's |
| 11 | | designee, or a trained overdose responder for an organization |
| 12 | | enrolled in the Drug Overdose Prevention Program administered |
| 13 | | by the Department of Human Services, Division of Substance Use |
| 14 | | Prevention and Recovery may dispense drug adulterant testing |
| 15 | | supplies to any person. Any drug adulterant testing supplies |
| 16 | | to be dispensed under this Section must be stored at a licensed |
| 17 | | pharmacy, hospital, clinic, or other health care facility, or |
| 18 | | at the medical office of a physician, advanced practice |
| 19 | | registered nurse, or physician assistant, or at the premises |
| 20 | | of the organization enrolled in the Drug Overdose Prevention |
| 21 | | Program. Drug adulterant testing supplies shall also be stored |
| 22 | | so that they are accessible only by and in a manner that limits |
| 23 | | access to the drug adulterant testing supplies to pharmacists, |
