| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Critical Health Problems and Comprehensive |
| 5 | | Health
Education Act is amended by changing Section 3 as |
| 6 | | follows:
|

| 9 | | Sec. 3. Comprehensive Health Education Program. The |
| 10 | | program established
under this Act shall include, but not be |
| 11 | | limited to, the following major
educational areas as a basis |
| 12 | | for curricula in all elementary and secondary
schools in this |
| 13 | | State: human ecology and health; human growth and
development; |
| 14 | | the emotional, psychological, physiological, hygienic, and
|
| 15 | | social responsibilities of family life, including sexual |
| 16 | | abstinence until
marriage; the prevention and control of |
| 17 | | disease, including instruction in
grades 6 through 12 on the |
| 18 | | prevention, transmission, and spread of AIDS; age-appropriate |
| 19 | | sexual abuse and assault awareness and prevention education in |
| 20 | | grades pre-kindergarten through 12; public and environmental |
| 21 | | health; consumer health; safety education and
disaster |
| 22 | | survival; mental health and illness; personal health habits;
|
| 23 | | alcohol and drug use and abuse, including the medical and |
|

| 1 | | legal ramifications
of alcohol, drug, and cannabis tobacco |
| 2 | | use; abuse during pregnancy; evidence-based and medically |
| 3 | | accurate information regarding sexual
abstinence; tobacco and |
| 4 | | e-cigarettes and other vapor devices, including the medical |
| 5 | | and legal ramifications of tobacco use; nutrition; and dental |
| 6 | | health. The instruction on mental health and illness must |
| 7 | | evaluate the multiple dimensions of health by reviewing the |
| 8 | | relationship between physical and mental health so as to |
| 9 | | enhance student understanding, attitudes, and behaviors that |
| 10 | | promote health, well-being, and human dignity. The program |
| 11 | | shall also provide course material and instruction to advise |
| 12 | | pupils of the Abandoned Newborn Infant Protection Act.
The |
| 13 | | program shall include information about cancer, including, |
| 14 | | without limitation, types of cancer, signs and symptoms, risk |
| 15 | | factors, the importance of early prevention and detection, and |
| 16 | | information on where to go for help. Notwithstanding the above |
| 17 | | educational areas, the following areas may also
be included as |
| 18 | | a basis for curricula in all elementary and secondary
schools |
| 19 | | in this State: basic first aid (including, but not limited to,
|
| 20 | | cardiopulmonary resuscitation and the Heimlich maneuver), |
| 21 | | heart disease, diabetes, stroke, the
prevention of child |
| 22 | | abuse, neglect, and suicide, and teen dating violence in |
| 23 | | grades 7 through 12. Beginning with the 2014-2015 school year, |
| 24 | | training on how to properly administer cardiopulmonary |
| 25 | | resuscitation (which training must be in accordance with |
| 26 | | standards of the American Red Cross, the American Heart |
|

| 1 | | Association, or another nationally recognized certifying |
| 2 | | organization) and how to use an automated external |
| 3 | | defibrillator shall be included as a basis for curricula in |
| 4 | | all secondary schools in this State. |
| 5 | | The school board of each
public elementary and secondary |
| 6 | | school in the State
shall encourage all teachers and other |
| 7 | | school personnel to acquire,
develop, and maintain the |
| 8 | | knowledge and skills necessary to properly
administer |
| 9 | | life-saving techniques, including, without limitation, the
|
| 10 | | Heimlich maneuver and rescue breathing.
The training shall be |
| 11 | | in
accordance with standards of the
American Red Cross, the |
| 12 | | American Heart Association, or another nationally
recognized |
| 13 | | certifying organization.
A school board may use the
services |
| 14 | | of non-governmental entities whose personnel have expertise in
|
| 15 | | life-saving techniques to instruct teachers and other school |
| 16 | | personnel in
these techniques. Each school board
is encouraged |
| 17 | | to have in
its employ, or on its volunteer staff, at least one |
| 18 | | person who is certified, by
the American Red Cross or by |
| 19 | | another qualified certifying agency,
as qualified to |
| 20 | | administer first aid and
cardiopulmonary resuscitation. In |
| 21 | | addition, each school board is authorized to
allocate |
| 22 | | appropriate portions of its institute or inservice days to |
| 23 | | conduct
training programs for teachers and other school |
| 24 | | personnel who have expressed an
interest in becoming qualified |
| 25 | | to administer emergency first aid or
cardiopulmonary |
| 26 | | resuscitation. School boards are urged to
encourage their |

| 1 | | teachers and other school personnel who coach school athletic
|
| 2 | | programs and other extracurricular school activities to |
| 3 | | acquire, develop, and
maintain the knowledge and skills |
| 4 | | necessary to properly administer first aid
and cardiopulmonary |
| 5 | | resuscitation in accordance with standards and requirements
|
| 6 | | established by the American Red Cross or another qualified |
| 7 | | certifying agency. Subject to appropriation, the State Board |
| 8 | | of Education shall establish and administer a matching grant |
| 9 | | program to pay for half of the cost that a school district |
| 10 | | incurs in training those teachers and other school personnel |
| 11 | | who express an interest in becoming qualified to administer |
| 12 | | cardiopulmonary resuscitation (which training must be in
|
| 13 | | accordance with standards of the
American Red Cross, the |
| 14 | | American Heart Association, or another nationally
recognized |
| 15 | | certifying organization) or in learning how to use an |
| 16 | | automated external defibrillator. A school district that |
| 17 | | applies for a grant must demonstrate that it has funds to pay |
| 18 | | half of the cost of the training for which matching grant money |
| 19 | | is sought. The State Board of Education shall award the grants |
| 20 | | on a first-come, first-serve basis.

| 21 | | No pupil shall be
required to take or participate in any |
| 22 | | class or course on AIDS or family
life instruction or to |
| 23 | | receive training on how to properly administer cardiopulmonary |
| 24 | | resuscitation or how to use an automated external |
| 25 | | defibrillator if his or her parent or guardian submits written |
| 26 | | objection
thereto, and refusal to take or participate in the |
|

| 1 | | course or program or the training shall
not be reason for |
| 2 | | suspension or expulsion of the pupil.
|
| 3 | | Curricula developed under programs established in |
| 4 | | accordance with this
Act in the major educational area of |
| 5 | | alcohol and drug use and abuse, including cannabis, shall
|
| 6 | | include classroom instruction in grades 5 through 12. The |
| 7 | | instruction,
which shall include matters relating to both the |
| 8 | | physical and legal effects
and ramifications of drug and |
| 9 | | substance abuse, including cannabis, shall be integrated into
|
| 10 | | existing curricula; and the State Board of Education shall |
| 11 | | develop and make
available to all elementary and secondary |
| 12 | | schools in this State
instructional materials and guidelines |
| 13 | | which will assist the schools in
incorporating the instruction |
| 14 | | into their existing curricula. In
addition, school districts |
| 15 | | may offer, as part of existing curricula during
the school day |
| 16 | | or as part of an after school program, support services and
|
| 17 | | instruction for pupils or pupils whose parent, parents, or |
| 18 | | guardians are
chemically dependent.

| 8 | | changes in a statute that is represented in this Act by text |
| 9 | | that is not yet or no longer in effect (for example, a Section |
| 10 | | represented by multiple versions), the use of that text does |
| 11 | | not accelerate or delay the taking effect of (i) the changes |
| 12 | | made by this Act or (ii) provisions derived from any other |
| 13 | | Public Act. |
| 14 | | Section 99. Effective date. This Act takes effect upon |
| 15 | | becoming law. |
