| 1 | | AN ACT concerning local government.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Township Code is amended by adding Section |
| 5 | | 85-70 as follows:
|
| 6 | | (60 ILCS 1/85-70 new) |
| 7 | | Sec. 85-70. Contracts entered into close to or after an |
| 8 | | election. |
| 9 | | (a) A township board of trustees or township official may |
| 10 | | not enter into or authorize an employment, equipment, or |
| 11 | | service contract during the 14 days before a consolidated |
| 12 | | election through the third Monday in May following the |
| 13 | | consolidated election. |
| 14 | | (b) Notwithstanding subsection (a), a township board or |
| 15 | | township official may enter into a contract that does not |
| 16 | | extend more than 60 days after the third Monday of May |
| 17 | | following the consolidated election to address an emergency. |
| 18 | | As used in this subsection, "emergency" means a condition |
| 19 | | requiring immediate action to suppress or prevent the spread |
| 20 | | of disease or to prevent or remove imminent danger to persons |
| 21 | | or property. |
| 22 | | (c) An employment, equipment, or service contract entered |
| 23 | | into or authorized in violation of this Section is voidable.
