| 1 | AN ACT concerning education.
| ||||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The School Code is amended by changing Sections | ||||||||||||||||||||||||||
| 5 | 10-20.63 and 34-18.56 as follows: | ||||||||||||||||||||||||||
| 6 | (105 ILCS 5/10-20.63) | ||||||||||||||||||||||||||
| 7 | Sec. 10-20.63. Availability of menstrual feminine hygiene | ||||||||||||||||||||||||||
| 8 | products. | ||||||||||||||||||||||||||
| 9 | (a) The General Assembly finds the following: | ||||||||||||||||||||||||||
| 10 | (1) Menstrual Feminine hygiene products are a health | ||||||||||||||||||||||||||
| 11 | care necessity and not an item that can be foregone or | ||||||||||||||||||||||||||
| 12 | substituted easily. | ||||||||||||||||||||||||||
| 13 | (2) Access to menstrual feminine hygiene products is a | ||||||||||||||||||||||||||
| 14 | serious and ongoing need in this State. | ||||||||||||||||||||||||||
| 15 | (3) When students do not have access to affordable | ||||||||||||||||||||||||||
| 16 | menstrual feminine hygiene products, they may miss | ||||||||||||||||||||||||||
| 17 | multiple days of school every month. | ||||||||||||||||||||||||||
| 18 | (4) When students have access to quality menstrual | ||||||||||||||||||||||||||
| 19 | feminine hygiene products, they are able to continue with | ||||||||||||||||||||||||||
| 20 | their daily lives with minimal interruption. | ||||||||||||||||||||||||||
| 21 | (b) In this Section: | ||||||||||||||||||||||||||
| 22 | "Menstrual hygiene products" "Feminine hygiene products" | ||||||||||||||||||||||||||
| 23 | means tampons and sanitary napkins for use in connection with | ||||||||||||||||||||||||||

| 1 | the menstrual cycle. | ||||||
| 2 | "School building" means any facility (i) that is owned or | ||||||
| 3 | leased by a school district or over which the school board has | ||||||
| 4 | care, custody, and control and (ii) in which there is a public | ||||||
| 5 | school serving students in grades 6 through 12. | ||||||
| 6 | (c) A school district shall make menstrual feminine | ||||||
| 7 | hygiene products available, at no cost to students, in each | ||||||
| 8 | bathroom of every school building the bathrooms of school | ||||||
| 9 | buildings.
