Amends the Criminal Code of 2012. Provides that a person who intentionally misrepresents an animal as a service animal commits a petty offense. Provides that a person commits intentional misrepresentation of an animal as a service animal when the person: (1) intentionally misrepresents an animal in his or her possession as his or her service animal; (2) was previously given a warning that it is illegal to intentionally misrepresent an animal as a service animal; and (3) knows that the animal is a not a service animal.

| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 2012 is amended by adding |
| 5 | | Section 48-8.5 as follows: |
| 6 | | (720 ILCS 5/48-8.5 new) |
| 7 | | Sec. 48-8.5. Misrepresentation of service animal. |
| 8 | | (a) A person commits the offense of intentional |
| 9 | | misrepresentation of an animal as a service animal when: |
| 10 | | (1) the person intentionally misrepresents an animal |
| 11 | | in his or her possession as his or her service animal, or a |
| 12 | | person with a disability's service animal whom the person |
| 13 | | is assisting by controlling, for the purpose of obtaining |
| 14 | | any of the rights or privileges set forth in State or |
| 15 | | federal law; |
| 16 | | (2) the person was previously given a written or verbal |
| 17 | | warning regarding the fact that it is illegal to |
| 18 | | intentionally misrepresent an animal as a service animal; |
| 19 | | and |
| 20 | | (3) the person knows that the animal is not a service |
| 21 | | animal. |
| 22 | | (b) A person who violates this Section commits a petty |
| 23 | | offense. |
