| 3 | | line 5, by replacing "as" with "and adding Section 35 as"; and

| 4 | | on page 1, by replacing lines 12 through 15 with the following: |
| 5 | | "(b) Nothing in this Act shall be deemed to apply in any |
| 6 | | manner to a private entity that complies construed to conflict |
| 7 | | with
the X-Ray Retention Act, the federal Health Insurance

| 8 | | Portability and Accountability Act of 1996 as amended by the |
| 9 | | Health Information Technology for Economic and Clinical Health |
| 10 | | Act of 2009, the Personal Information Protection Act, and the |
| 11 | | rules
promulgated under those Acts either Act."; and

| 12 | | on page 2, by replacing line 8 with "information or biometric |
| 13 | | identifiers if: (i) the biometric information or biometric |
| 14 | | identifiers are used"; and

| 15 | | on page 2, line 12, by changing "or (iii)" to "and (iii)"; and
