| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2662 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 1. Short title. This Act may be cited as the Task |
| 5 | | Force on Human Services Contracting Act. |
| 6 | | Section 5. Findings. The General Assembly finds all of the |
| 7 | | following: |
| 8 | | (1) According to a 2010 survey, the State of Illinois |
| 9 | | had 7,625 contracts and grants with nonprofit human service |
| 10 | | providers. |
| 11 | | (2) Among all states, Illinois ranked at the bottom, |
| 12 | | that is number one, for the percentage of nonprofit human |
| 13 | | service providers with late payments. |
| 14 | | (3) Illinois ranked third from the bottom, that is |
| 15 | | number 3, for the percentage of nonprofit human service |
| 16 | | providers having problems with changes to contracts and |

| 1 | | grants. |
| 2 | | (4) Illinois ranked third from the bottom, that is |
| 3 | | number 3, for the percentage of nonprofit human service |
| 4 | | providers having problems with payments not covering full |
| 5 | | costs. |
| 6 | | (5) State government relies heavily on nonprofit human |
| 7 | | service providers to deliver a range of essential services, |
| 8 | | from youth services to job training to services for older |
| 9 | | adults, but little is known about the effectiveness of the |
| 10 | | partnership. |
| 11 | | (6) In 2016, Illinois Partners for Human Service |
| 12 | | conducted a research study and found that reimbursement |
| 13 | | rates in nearly every field have fallen behind the cost of |
| 14 | | living, steadily losing value; and that stagnant |
| 15 | | reimbursement rates present severe challenges, including |
| 16 | | difficulty covering operating costs, high employee |
| 17 | | turnover, and an inability to meet increased needs. |
| 18 | | Section 10. Purpose. It is the purpose of this Act to |
| 19 | | create a task force to study State contracting with private |
| 20 | | nonprofit human service providers and the challenges faced by |
| 21 | | those providers, and to develop recommendations on how to |
| 22 | | improve the contracting relationship and partnership between |
| 23 | | State departments and agencies and private nonprofit human |
| 24 | | service providers so that they work effectively and efficiently |
| 25 | | to improve the well-being of Illinoisans. |

| 1 | | Section 15. Task Force on State Contracting with Private |
| 2 | | Nonprofit Human Service Providers. |
| 3 | | (a) The Task Force on State Contracting with Private |
| 4 | | Nonprofit Human Service Providers is created to study State |
| 5 | | contracting with private nonprofit human service providers and |
| 6 | | to develop recommendations on how to improve the contracting |
| 7 | | relationship and partnership between State departments and |
| 8 | | agencies and private nonprofit human service providers so that |
| 9 | | they work effectively and efficiently to improve the well-being |
| 10 | | of Illinoisans. The Task Force shall perform the following |
| 11 | | actions: |
| 12 | | (1) Review data provided by State departments and |
| 13 | | agencies that contract with private nonprofit human |
| 14 | | service providers regarding the effectiveness of the |
| 15 | | system of service provision. |
| 16 | | (2) Collect and review data on each of the following: |
| 17 | | (A) Service system planning: the means by which |
| 18 | | State departments and agencies and private nonprofit |
| 19 | | human service providers assess needs, identify gaps, |
| 20 | | and establish system goals, especially the flow of |
| 21 | | information collected by the State departments and |
| 22 | | agencies and shared back with private nonprofit human |
| 23 | | service providers. |
| 24 | | (B) Contract negotiation: the process by which |
| 25 | | State departments and agencies engage private |

| 1 | | nonprofit human service providers to provide specific |
| 2 | | services and achieve specific goals, especially the |
| 3 | | adequacy of time to review and adjust. |
| 4 | | (C) Reimbursement rate methodologies: the |
| 5 | | processes by which State departments and agencies |
| 6 | | establish rates, the frequency of review and |
| 7 | | adjustment, and the adequacy of those rates to achieve |
| 8 | | the outcomes sought by the State. |
| 9 | | (D) Monitoring of service and administration: the |
| 10 | | process by which State departments and agencies |
| 11 | | evaluate performance, especially the efficiency of |
| 12 | | data collection and review, and prevent or resolve |
| 13 | | processes and reports that are duplicative, costly, |
| 14 | | and wasteful of staff time and that slow the process of |
| 15 | | permanency and contribute to unnecessary staff |
| 16 | | turnover. |
| 17 | | (E) Business processes: the means by which State |
| 18 | | departments and agencies provide approvals for |
| 19 | | services, activities, plans and changes, especially |
| 20 | | preventing the unnecessary delays that arise from |
| 21 | | delayed or slowed approvals, which also slow the |
| 22 | | process of permanency and unnecessarily add to the |
| 23 | | stress and trauma experience of children in State care. |
| 24 | | (F) Timely payment: the process by which State |
| 25 | | departments and agencies make payments, including the |
| 26 | | timeliness of payments and the opportunities for |
|

| 1 | | appeal; and the court of claims process as it relates |
| 2 | | to human service contracting. |
| 3 | | (3) In each of the study categories described in |
| 4 | | subparagraphs (A) through (F) of paragraph (2), develop |
| 5 | | recommendations on how to improve the contracting |
| 6 | | relationship and partnership between State departments and |
| 7 | | agencies and private nonprofit human service providers so |
| 8 | | that they work effectively and efficiently to improve the |
| 9 | | well-being of Illinoisans. The Task Force shall also issue |
| 10 | | specific recommendations on procedures that will improve |
| 11 | | the court of claims process, as it relates to human service |
| 12 | | contracting, to make it operate more expeditiously and |
| 13 | | efficiently. |
| 14 | | (b) Members of the Task Force shall include: |
| 15 | | (1) 2 legislative members appointed by the Speaker of |
| 16 | | the House of Representatives, one of whom shall be |
| 17 | | designated as Co-Chairperson; |
| 18 | | (2) 2 legislative members appointed by the Minority |
| 19 | | Leader of the House of Representatives; |
| 20 | | (3) 2 legislative members appointed by the President of |
| 21 | | the Senate, one of whom shall be designated as |
| 22 | | Co-Chairperson; |
| 23 | | (4) 2 legislative members appointed by the Senate |
| 24 | | Minority Leader; |
| 25 | | (5) 6 members who are representatives of private |
| 26 | | nonprofit human service providers from each of the regions |

| 1 | | of the Department of Children and Family Services, |
| 2 | | appointed by the co-chairs; |
| 3 | | (6) the Director of Children and Family Services, or |
| 4 | | his or her designee; |
| 5 | | (7) the Director of the Governor's Office of Management |
| 6 | | and Budget, or his or her designee; |
| 7 | | (8) the chief executive officer of the Illinois |
| 8 | | Collaboration on Youth, or his or her designee; |
| 9 | | (9) the executive director of Illinois Partners for |
| 10 | | Human Service, or his or her designee; and |
| 11 | | (10) the president and chief executive officer of |
| 12 | | Forefront, or his or her designee. |
| 13 | | (c) The Task Force may establish a method to gather |
| 14 | | testimony and input from individuals and organizations that are |
| 15 | | not members of the Task Force. |
| 16 | | (d) The Office of the Auditor General shall provide |
| 17 | | administrative and other support to the Task Force. |
| 18 | | (e) The Task Force shall submit a preliminary electronic |
| 19 | | report to the Auditor General, the General Assembly, and the |
| 20 | | Governor no later than October 1, 2019, and a final electronic |
| 21 | | report, along with recommendations and any proposed |
| 22 | | legislation, to the General Assembly and the Governor by |
| 23 | | January 1, 2020. The Task Force is dissolved on January 1, |
| 24 | | 2021.

| 25 | | Section 20. Repeal. This Act is repealed on January 1, |
