| 1 |  |     AN ACT concerning local government.

| 2 |  |     Be it enacted by the People of the State of Illinois,

| 3 |  | represented in the General Assembly:

| 4 |  |     Section 5. The Volunteer Emergency Worker Job Protection  | 
| 5 |  | Act is amended  by changing Section 3 as follows:

| 7 |  |     Sec. 3. Definitions. As used in this Act:  | 
| 8 |  |     "Volunteer emergency worker" means a person who serves as a  | 
| 9 |  | member of a fire department of a fire protection district,  | 
| 10 |  | municipality, or other unit of government on other than a  | 
| 11 |  | full-time career basis and who meets the requirements for  | 
| 12 |  | volunteer status provided in Section 553.106 of Title 29 of the  | 
| 13 |  | Code of Federal Regulations and United States Department of  | 
| 14 |  | Labor Wage and Hour Opinion Letter FLSA 2006-28 and United  | 
| 15 |  | States Department of Labor Wage and Hour Opinion Letter FLSA  | 
| 16 |  | 2005-51 firefighter who does not receive monetary compensation  | 
| 17 |  | for his or her services to a fire department or fire protection  | 
| 18 |  | district and who does not work for any other fire department or  | 
| 19 |  | fire protection district for monetary compensation. "Volunteer  | 
| 20 |  | emergency worker" also means, including, but not limited to, a  | 
| 21 |  | person who serves on a volunteer basis and is licensed under  | 
| 22 |  | the Emergency Medical Services (EMS) Systems Act as an  | 
| 23 |  | Emergency Medical Responder (EMR)(First Responder), Emergency  |

| 1 |  | Medical Technician (EMT),  Emergency Medical  | 
| 2 |  | Technician-Intermediate (EMT-I), Advanced Emergency Medical  | 
| 3 |  | Responder (A-EMT), or Paramedic (EMT-P), or a volunteer  | 
| 4 |  | ambulance driver or attendant, and  the person does not work in  | 
| 5 |  | one of these capacities for another fire department, fire  | 
| 6 |  | protection district, or governmental entity on a full-time  | 
| 7 |  | career basis who does not receive monetary compensation for his  | 
| 8 |  | or her services as a volunteer Emergency Medical Technician  | 
| 9 |  | (licensed as an EMT, EMT-I, A-EMT, or Paramedic under the  | 
| 10 |  | Emergency Medical Services (EMS) Systems Act), a volunteer  | 
| 11 |  | ambulance driver or attendant, or a volunteer "Emergency  | 
| 12 |  | Medical Responder", as defined in Sec. 3.50 of the Emergency  | 
| 13 |  | Medical Services (EMT) Systems Act, to a fire department, fire  | 
| 14 |  | protection district, or other governmental entity and who does  | 
| 15 |  | not work in one of these capacities for any other fire  | 
| 16 |  | department, fire protection district, or governmental entity  | 
| 17 |  | for monetary compensation. "Volunteer emergency worker" also  | 
| 18 |  | means a person who is a volunteer member of a county or  | 
| 19 |  | municipal emergency services and disaster agency pursuant to  | 
| 20 |  | the Illinois Emergency Management Agency Act, an auxiliary  | 
| 21 |  | policeman appointed pursuant to the Municipal Code, or an  | 
| 22 |  | auxiliary deputy appointed by a county sheriff pursuant to the  | 
| 23 |  | Counties Code.

| 24 |  |     "Monetary compensation" does not include a monetary  | 
| 25 |  | incentive  awarded to a firefighter by the board of trustees of  | 
| 26 |  | a fire protection district under Section 6 of the Fire  |
