| 1 | | municipality in Cook County that either receives water directly |
| 2 | | from Lake Michigan or buys its water from another municipality |
| 3 | | and then sells some of its water to another municipality. |
| 4 | | (b) The Cook County Water Infrastructure Fund is created as |
| 5 | | a special fund in the State treasury. Moneys in the Fund shall |
| 6 | | be used by the Environmental Protection Agency to make grants |
| 7 | | to municipalities to fund infrastructure improvements to |
| 8 | | facilitate water supplies from Lake Michigan for residents of |
| 9 | | Cook County. |
| 10 | | Notwithstanding any other provision of law, the Cook County |
| 11 | | Water Infrastructure Fund is not subject to sweeps, |
| 12 | | administrative charges or chargebacks, or any other fiscal or |
| 13 | | budgetary maneuver that would in any way transfer any funds |
| 14 | | from the Cook County Water Infrastructure Fund into any other |
| 15 | | fund of the State. |
| 16 | | (c) In making grants from the Cook County Water |
| 17 | | Infrastructure Fund, the Agency must prioritize water |
| 18 | | infrastructure projects in non-supplying municipalities in |
| 19 | | Cook County over water infrastructure projects in supplying |
| 20 | | municipalities in Cook County. |
| 21 | | (d) The Environmental Protection Agency may adopt rules |
| 22 | | under the Illinois Administrative Procedure Act to implement |
| 23 | | this Section.

| 24 | | Section 99. Effective date. This Act takes effect upon |
| 25 | | becoming law.".
